Call the attorney that advertises "have you been in an accident with a truck driver "please call" and ask him if I am over my hours or falsifying my logs and I get in an accident and someone gets killed, what will happen to me. Let me know the answer, I would do it, but I ALREADY KNOW THE ANSWER! And you would not believe the ANSWER!
The only information I could find was from Florida DOT that stated "A driver in violation of some requirements regarding hours of service (such as not having a log book when required, or exceeding the driving time limitations) may be placed out of service and assessed a penalty of $100.00. A Uniform Traffic Citation may be issued for some violations."

At most a log violation is an infraction that you can be cited for just as you would be if you were caught speeding. It is not a misdemeanor or felony crime. By the way, if you killed someone in a collision the last thing prosecutors would charge you with would be an HOS violation. I would think you as a driver would be way more concerned about manslaughter or vehicular homicide charges that an infraction.
