And if you have not done so you need to contact DAC and request a copy of your employment file so you will know exactly what is on there. Could be other things that are wrong or that you simply need to know about so you can put them on any application.

okay an update:

WoW what a rollercoaster.

ive been applying for jobs left and right and no one would touch me and none of them would say why. a few did the old you were terminated and never got past that point.

needless to say i got in touch with a company that was considering me and they ran my dac report and found out i have been charged by J.B.Hunt for abandoning my truck when i quit..

OH MY GOD.. i was floored. i left j.b.hunt without notice of course. but i called them and made arangements to turn the truck in (which was turned in the night i left). i turned the truck into thier atlanta yard which is where they told me to take it. turned in my keys, my toll cards and all the items they asked for.

all this was documented on the qualcomm i even asked was there anything else i needed to do and they said no. i sent back that everything was turned in, my gear was out of the truck. i left the truck INSIDE The gate at thier Main Terminal in atlanta where i was hired.. Sitting 25 Feet in Front of Maintenence Bays...gave them everything they asked for.. and now they have me as abandoning my truck on jbhunt property.

between my termination and this.. no company will touch me. even the bottom feeders you told me to try are saying no thanks.

what can i do!!!?!!!
i would get a lawyer and sue their pants off !

Before going that route it would be best to:

1. Ask the company to remove the entry,
2. Go through channels at DAC and dispute the entry if the first doesn't work.
3. If still no luck then hire an attorney to write the company a letter asking them to remove the entry.
4. Final step would be to file legal action.

Unfortunately if you did not get some kind of signed "receipt" showing that you turned the truck in it really boils down to your word against their's.

Truck driving is a "game" of CYA from day 1. When it comes to equipment careful note should be made of what was given you and the condition it is in when assigned and again when you turn in that equipment, even if it is a reassignment with the same company.

A company that lists something like this on a driver's employment/safety file may not have done so intentionally. It is possible they may have had truck 123 abandoned and when entering it into the computer they listed truck 132 as the one being abandoned. This is really easy to do at really large companies whose truck numbers may be 5, 6 or even more digits.

i've heard you can tug on it, and it still can be not fully latched. And you wont find out till you make that first turn.

I carry a LED mini-mag on my belt, and i always take it out and check the locking jaw, daylight or not, to make sure it is locked. I do the tug-test too, and always tug and use the light everytime i stop at a truck stop. never know who wants to be a joker, and pull your 5th wheel.

my DM told me, the company wont audit you books if they are 30+ days old. I only keep 7 days worth of logs on the truck at all times. (pssst..the old pages go into a minilla envelope with a stamp and an address, and if i ever get pulled around, the first thing i do is seal that envelope, so they'd have to get a post master or a marshal to open it)

my thoughts exactly............nowadays the company has the upper hand. Things that werent deemed permissable to fire you are now permissable. Assuming you had a Qualcomm, u needed to be taking a 10hour break. Most mega carriers have to ability to track your every movement. Your best bet is to find a small company that needs drivers but be prepared to drive on their terms. BOL

Although I've only been driving 42 months I had quite an experience. I had a job for a local co. hauling patties out of Keystone/Equity N. Baltimore, Oh. to Solon, Oh. Six to seven weeks into it I was thinking to myself "Noth'in to this". Just a bit over-confident. The mechanics serviced my truck that night so I had to drop in a stone lot. Dumped the air-bags and parked it next to the shop. Next morning I coupled and drove the two miles to get loaded. Loaded I drove to Solon, Oh., delivered and proceded to head home. I had just went over an over-pass by the airport and heard and felt something. I glanced at my drivers side mirror and there were my glad-hands and half the width of the reefer staring at me. Smoke rolling of the tandems, I was able to get to the shoulder with-out the trailer coming completely off. Sitting there I was taking in what had just happened and thanking God it did'nt come totally off. I retraced my day and realized that in the morning when I coupled back to the trailer the air-bags were still deflated. My fault. To make a long story short? If I would've done a pre-trip I most likely would've noticed a gap between the fifth-wheel and plate. Now EVERY time I couple to a trailer I get out of the truck and look to make sure there is no gap and actually do a solid inspect before moving an inch. Although the fifth-wheel had to be replaced it upsets my stomach to think how much worse it coul've turned out for an innocent family running alongside the road next to me. Something I will never forget.

company SHOULD have the upper hand. though it would be nice to have unions back so that our 'rights' as union members could be supported. have a legal means to fight back without fearing for our jobs.

we work for the company....the company dont work for us.

Okay i now need serious help.

Ive followed up with J.B.Hunt's human resorces and they said they did a full internal check and that its coming back i abandoned my truck.

I turned my truck into the atlanta yard where they have a 100+ other trucks.

I Dropped my trailer in the trailer yard, which is inside the atlanta yard.

Another Driver asked me to put in an empty call so he could have my trailer. i did so. the driver left with my trailer from the atlanta yard.

my qualcomm should show i was in the atlanta yard when i sent my last message "is there anything else i need to do?"

I was instructed to take it to the atlanta yard was even given directions via qualcomm..

J.B.Hunt Refuses to take the abandonment off.

No one will hire me due to this. coupled with my termination from reohl im pretty much blackballed that i can see. ive tried putting apps in companies that do the multi trucking company thing.. and still no luck.

ive called drivers legal plan and a lawyer advertising for trucking accidents. no one wants to touch this. what can i do??

I need a lawyer and cant seem to find one that will take the case. just a whole bunch of "we will call you back"

did you take pictures of the qcomm messages or have someone sign a receipt that you turned in the truck? if you didn't its pretty much your word against theirs. i'll never understand guys that drop off trucks without getting something signed to prove it. they made you sign something when you picked it up? you probably did a walk around and signed off on it when you were assigned that truck. why would you not do the same when you turned it in? unfortunately your learning the hard way why not crossing your t's and having all your ducks in row can come back to bite you.
