To answer your original question, no I wouldn't hire him. Having said that though, I don't doubt that somebody out there would including some of the larger companies.
I personally know a guy who got fired last December from Indian River because he had a random and tested positive for cocaine. Just a few weeks ago he went back to work pulling a tank for Bynum. He never mentioned the failed drug test to them. Apparently he passed their test and Bynum either never checked or IR didn't put it on the DAC. I thought it all went into a database and it wouldn't make a difference what info they got from IR, Bynum would still find the results? I've known the guy for a couple of years and I never would have dreamed that he was the type to do coke. We had a long talk about what happened, but I didn't call Bynum.
How about this? Rather than call his employer maybe you can help your brother get the help he needs for his problem? If you do that, the safety of everyone sharing the road with him will straighten itself out. If you just pick up the phone and call his employer, he will just find another employer. And believe me there are plenty out there who will hire him regardless of whether they know his past or not. Are you just gonna follow him around and call every employer that gives him a job without checking his DAC? If so, he'll probably keep you pretty busy for quite a while.
