Surprisingly it wasnt which is why I was cruising along at 50-55mph.

When I got to Kansas, it was different. Course, didnt matter, my truck broke the crankshaft so I had to hang in Colby, KS a few days. :roll: 1 degree at nite it was, not to mention the windchill factor.

Default NOT GUILTY

For anyone who is still interested in this topic, I just got back from my hearing in Seattle. A court of law found me NOT GUILTY of 2nd Degree Negligent Driving. I know some of you will surely be pissed because I "must have worked the system" but that is certainly not the case. This was not a jury trial, with everyday people who might acquit me because they sympathize with me. It was a hearing, with a codgy, grumpy judge who didnt like me from the start. I had no fancy lawyer. Instead I simply represented myself. After hearing all the FACTS and EVIDENCE (not what he heard on the news), and testimony from the officer he determined that I was not at faultand NOT GUILTY. He was able to look past my prior record and recognize the fact that because Ive had tickets in the past (none of which being commercial) that I wasnt automatically guilty of this charge. To all those who gave me the benefitof the doubt, again I thank you. To everyone else, maybe this will change your mind. If not, oh well, I'm over it.

I was qualified with Atlas via agent 729. Atlas has one of the strictest hiring requirements, parallelling United/Mayflower.

Remember, 3 sides to ever story- 1 person's side, the oher person's side, and what REALLY happened.

were you found guilty of anything or was this the only charge?
I surley hope that you are doing something about the news reports if indeed they were misreported.

Don’t let it bother you, most of the posters here are really back seat drivers anyway….lol
They are quick to point the finger so they can say “ I would never do this, so I must be better than him” To give them the GOD status they want so much…lol They are easy to spot on this forum!!!

Why?? Because of the ""I represented myself" bit, and the attitude that you bring here.

Since you've discussed this much, would you mind providing a Case# or Cause#, so that your claims can be verified?? (Those ARE matters of public record, so I'm not asking you to disclose personal information.

I just don’t believe the bad in someone until it proved beyond the shadow of a doubt! On this forum it seems that a person is guilty until proven innocent. No one would stand for this when it comes to their rights in a court of law, but the hypocrites come out of the woodwork whenever they want! We never get the truth here Useless, and we really never know for sure what’s BS and what’s not, so how can we really make an opinion on the matter written in this forum? There have been some good sob stories here, and some have been taken in, but YOU still never know for SURE!
Oh, I dont use gieco....lol

You are correct, we often do not get the truth here. That's why I asked for a Case# / Cause#. And, I am wanting to be honest, without being an assh*le.

I'm not meaning to be spiteful or vindictive here. It's just that I know several judges, and none of them would put up with the attitude coming from Biggs. Now, granted, the judges that I know are not up in those stomping grounds. They practice here in Texas, tenn. or North Carolina, so there could well be a vast difference in judicial temperament.

And, again, without wanting to be spiteful, but needing to be honest, his comments upon how he represented himself ring hollow. Any man who represents himself in a courtroom is a fool. With VERY few exceptions, they testify themselves into a conviction.

Now, the courts here in Texas WILL allow a person to represent himself in a criminal proceeding, but they will not do it readily or easily. That is the way it should be.

Sorry, but this rings too loudly of a truckstop coffee counter "Driver's Story"!!

NOW, IF I AM WRONG, THEN I WILL COME BACK, ISSUE A RETRACTION,
AND OFFER A FULL APOLOGY!!

I dont have a problem with anyone looking into my case. I dont have the case/cause number off-hand but I can get it and post it on here in the next few days. I represented myself not because I have an attitude, but because it made no sense to hire one. This was a civil matter, not criminal, so jail is not an option. The ticket was only $580 dollars and (I was surpised to hear from my ins. agent) would have only a minor impact on my insurance rate. A lawyer would have been at least $1,500. It would cost more to win with a lawyer than lose without one. Besides, the way I figured it, if I couldnt convince a judge I was innocent without a fancy lawyer then I was probably more guilty than I thought. For all those who believe that I never accept responsibility for my actions, know this: The judge offered everyone in the courtroom the option of taking a deferred finding which means that if you do not commit the same infraction for 1 year the whole thing goes away. I turned this down.

As far as the case number, the only thing I got at the hearing was another copy of the slip asking me to appear and I dont believe it had a case number but Im certain it has a citation number and most likely that will work. If not, let me know and I will do some digging.

My nephew is being born as we speak so dont plan on it till the weekend but I will get it out there.
