Default Possible changes to HOS regulations

A new transportation funding bill has been passed. It could possibly remove the 2011 restart provisions and restore the 2005 restart rules.

Is this a return to the hos where we can have multiple restarts during the week without having to take two consecutive days? There have been so many changes to the hos, it is hard to keep up.

Interesting, yes it was approved........out of committee. Still has to get approved by the full House and has to meet the Senate version.

But, here's the breakdown of the House version. The 2011 restart rules were suspended in 2014 by Congress.(That little unknown nugget could open up a bunch of lawsuits for HOS violations that maybe shouldn't have been)

The 2005 rules to return are, unlimited use of restarts and no more requirement for 2, 1am-5am periods in any restart. The 2nd one was a 2011 requirement.

It also would stop the FMCSA from continuing work on the Safety Fitness Determination rulemaking until Congress is satisfied that the FMCSA is finished fixing another CSA program required by MAP-21. No idea which of the programs it is, maybe the driver registry?

All HOS will also be made uniform........whatever that means!

The Senate version somewhat mirrors the House version except, it specifically addresses the 34 hour restart and the results of a Congress mandated FMCSA study on the restart provision from 2011. The ATA is pleased by this, they feel it will ensure all drivers will still be allowed to have it whereas rumor was, it was going to be taken away or shortened.
