When operating as a team. The co-driver goes to line 3 (Sleeper Berth) while the other driver operates the CMV.
Hmm.... last I checked, sleeper berth was line 2.

Since the off-duty (sleeper berthed) driver is relieved of all responsibility for operation of the CMV. As I understand Golfhobo's guidance to new drivers. Drinking alcoholic beverages while in the sleeper should not be a problem at all for the relieved driver on Line 3. How easy it is we forget that the sleeper is an entity entirely unto itself. I'm glad that Golfhobo cleared this up for us.
There are TWO regs that apply to this situation, young'en! I don't feel like quoting them, but the first is that the DRIVER cannot OPERATE a CMV with unmanifested alcohol on board. It is HIS responsibility to make sure there is no such alcohol on board BEFORE he starts to DRIVE the CMV.

Also, though it is disputed AND under review.... if the codriver were to come out of the sleeper and sit next to a DRIVER of a CMV (which means it HAS to be "in operation,") his duty status would be line 4... On Duty Not Driving. At this point, HE could not have any trace of alcohol in his system (above .02 BAC) or HE would be in violation of the regs.

[I HOPE you get my point...which is that the reg concerning the duty status of a co-driver (unless a trainer who does not drive) is line 4 IF and ONLY if he is seated next to someone DRIVING the CMV. It says nothing about the two of them sitting in the two seats of the cab while the truck is parked and they are BOTH "off-duty." The question did NOT say "what is the duty status of a co-driver (or ANY driver) seated in the passenger seat of a CMV which is parked.] I WONDER why that is? Could it be that the distinction is a CMV in OPERATION?

I'm thinking of trading in my local CDL for an OTR CDL and getting in on the party!
You really should! Try the "back row" at Ontario TA West! Hookers, drugs, alcohol to your heart's content! Of course, you won't find ME there! I stay away from such places and activities!

If stuck at a truckstop for the weekend and there's a great bar across town...is your truck then considered "personal conveyance" if you bobtail over for a couple brewskis?

And do you log line 5 if you're IN the bar drinking?

YES.... and

YES.... all time spent IN a bar drinking brewskis MUST be logged on line 5!

Someone mentioned a line 6, but I think that had to do with whether hookers were involved! :lol2:

I always thought line 5 was "sleeping while driving" like when you roll across I-80 in Nebraska......:lol:
