Some states are different in their interp of the Actual Physical Control.

I know for a fact that in North Dakota you just have to be in the vehical with the keys in your possesion.

But it doesn't matter actually because the laws are for ALL motor vehicals (except for passenger carrying such as buses and limos) and not just the 4 wheelers.

If your sleeper had a perm wall then you could be inside it intoxicated or with an open beer can.
Sure about that? Are those your words or the NDHP's?? Cuz if they said that.... the Rev is gonna call out the Federal Marshalls and have 'em set them boys straight!

Better run that by HIM, and get back to me!

Golfhobo, WHY do you INSIST on EMPHASIZING through CAPITALS or BOLD LETTERS every other WORD in your POSTS?

And WHY do you NEED to use an EMOTICON to emphasize EVERY thought you TYPE? :?:

Furthermore, WHY are you so ADAMANT about DRINKING in the truck despite the FACT that it is IRRESPONSIBLE, UNNECESSARY and bad for OUR industry as a WHOLE? ops:

Why are WE (those who state FACT not OPINION) PRUDES for not supporting something that has NO BUSINESS in our industry?

If I was YOUR BOSS and I got a CALL that YOU were spotting CARRYING or DRINKING ALCOHOL near MY truck, I might not LEGALLY be able to use ALCOHOL regulations to FIRE you, but you know WHAT? SUCKS TO BE YOU because you were 5 minutes LATE on that LOAD three weeks ago. YOU'RE FIRED.

Get my point?

Drink ALL you want. Just not in MY industry. :!:

For the same reason he inserts is own thoughts into other peoples' quotes. To annoy and confuse, because he is hoping everyone will ignore the fact that he is completely and utterly wrong.

Sorry Rev.... must have missed that. WHERE did you do so? I must've been busy chuckling over the fact that you and Rat STILL don't understand that BOTH line 2 and line 1 are considered off duty!

I dont want to get in the middle of things here.

But Hobo if line 1 and 2 are considered off duty. Then why do they have Sleeper berth ??

Bingo!!!!!!

Yeap if both are considered off duty then there would be no need for line two at all.

Oh well, no need arguing with Hobos. They live under bridges with Trolls don't they?

Hey I think I figured it out. Troll/Hobo/Troll Yeap Hobo = Troll. What is the run on the Internet?

Because of "split-logging." You cannot log 8 straight hours on line 1 and have it be OFF the clock (it would have to be 10 hours.) But, you can on line 2 as long as you combine it with the other 2 hour (minimum) break to meet your 10 hour OFF DUTY requirement.

Now, of course..... you may want to run that by the REV, who will tell you I am wrong, because HE doesn't believe line 2 qualifies as OFF DUTY, even when presented with the clear wording of the reg.

EDIT: You might also want to check with his "Mini-Me" RAT. He slurps up everything the REV says.

BTW, the regs also state that, if you have no sleeper berth, you don't even need a line 2 on your logsheet. As a local driver, you may have never seen such a grid.

Here's a bonus answer: Even if you logged only 8 hours on line 1, or 6 hours on line 2..... they would STILL be "off duty." They just wouldn't stop/pause/reset your clock. BOTH of those examples would count against your 14 hour clock.... except that the 6 hour line 2 entry (OR the 8 hour line 1 entry) could be used to satisfy the 2 hour break for "splitting" but would NOT be off the clock. You would still need 8 straight hours in the sleeper to qualify for splitting.

Sorry if I confused you. I just like to be thorough.

Actually, Hobos were known for riding the rails, and WORKING wherever they ended up. Yeah, some lived under bridges, where they spent much of their time either STEPPING ON or EATING "RATS!"

Sucks to be a RAT when a Hobo is hungry!
