Some states are different in their interp of the Actual Physical Control.
I know for a fact that in North Dakota you just have to be in the vehical with the keys in your possesion. But it doesn't matter actually because the laws are for ALL motor vehicals (except for passenger carrying such as buses and limos) and not just the 4 wheelers.

Since the Sleeper berth is not seperated by a perm wall then you can get an actual physical control violation for being intoxicated in the sleeper of your truck. All you have to do is be in the truck (sleeper berth) with the keys readily available and you able to get behind the controls while being intoxicated and you are in violation. If your sleeper had a perm wall then you could be inside it intoxicated or with an open beer can. Better run that by HIM, and get back to me! :wink:

SUCKS TO BE YOU because you were 5 minutes LATE on that LOAD three weeks ago. YOU'RE FIRED. :lol: Get my point? :wink: Drink ALL you want. Just not in MY industry. :!: -p.

I dont want to get in the middle of things here.
But Hobo if line 1 and 2 are considered off duty. Then why do they have Sleeper berth ??

Oh well, no need arguing with Hobos. They live under bridges with Trolls don't they? Hey I think I figured it out. Troll/Hobo/Troll Yeap Hobo = Troll. What is the run on the Internet? Now, of course..... you may want to run that by the REV, who will tell you I am wrong, because HE doesn't believe line 2 qualifies as OFF DUTY, even when presented with the clear wording of the reg. EDIT: You might also want to check with his "Mini-Me" RAT. He slurps up everything the REV says. BTW, the regs also state that, if you have no sleeper berth, you don't even need a line 2 on your logsheet. As a local driver, you may have never seen such a grid. Here's a bonus answer: Even if you logged only 8 hours on line 1, or 6 hours on line 2..... they would STILL be "off duty." They just wouldn't stop/pause/reset your clock. BOTH of those examples would count against your 14 hour clock.... except that the 6 hour line 2 entry (OR the 8 hour line 1 entry) could be used to satisfy the 2 hour break for "splitting" but would NOT be off the clock. You would still need 8 straight hours in the sleeper to qualify for splitting. Sorry if I confused you. I just like to be thorough. :wink:
