No where in any of the many articles has it said he was charged with a logbook violation. All the articles have said he had driven longer than was allowed. Dawn added this information without any supporting documents. When in fact the driver returned home and was arrested several days later and returned to Indianapolis. She then went on what I would call a rage about logbook violation.

Only time will tell if he is found guilty of these charges.

I think all driver knows what can happen when they violated the law.

Default Trainees BEWARE!

DAWN, I am grateful for this discussion. 'Someone I know...' is a new Trainee on the road for 6 wks with an Instructor who dictates the Trainee's log every day in order to cook the books and maximize his miles. The fleet mgr for this carrier knows all about this.

So this is the real world, but this 'Someone I know...' would really like to work legal for a legal carrier that doesn't talk doublespeak. New CDL in Missouri; conservative female, age 56, must be 'no touch freight'.

Just remember this ladies and gentlemen. Once you sign that log page for that day it is now a legal FEDERAL document.

WRONG.

It is a legal document even before you sign it. DOT can, and will, cite you for things on an unsigned log book page.

Question 3: If a driver's record of duty status is not signed, may enforcement action be taken on the current day's record if it contains false information?

Guidance: Enforcement action can be taken against the driver even though that record may not be signed. The regulations require the driver to keep the record of duty status current to the time of last change of duty status (whether or not the record has been signed). Also, §395.8(e) states that making false reports shall make the driver and/or the carrier liable to prosecution.

Weird. I guess, they have changed. When I first started out,I used to sign my log sheets right off the bat. During my first year out,I had a DOT man in Perryton,TX tell me that I shouldnt sign my log sheet, until I am done.
