It's called Cabotage and no it is not legal. A Canadian company can bring a load from Canada into the US and deliver it, and then can pick a load up in the US that goes back to Canada. As far as US carriers going into Canada, I do believe that there is a limit on how many stops they can make on a trip (3 i think), and I would assume that this would apply to Canadian carriers operating inside the US.

Canadian trucks if they have the running rights for that state, can run any where in the US same goes for US trucks, you can drop a load any where pick up a load drop it and pick another bound for your country of origin, so as long as it is on your way back..
Now if the company has a office and is registered in that country it can run just like a truck from that country, take a look at the door if it says John Doe trucking Detroit mi and Windsor ont .ca.
That truck can, if the company has the running rights, pick up and drop any where in the US and Canada. regardless of where the truck and trailer are plated.

I've never heard of a limit to the stops an ltl carrier can make when traveling in canada. I, myself, have done 5 separate HHG orders while in Canada, all originating in the U.S. There is a lot of procedure to follow above and beyond normal frieght, and stiff penalties for breaking seals early.

I can attest, that it is ilegal to bring domestic tonnage into Canada that is to be delivered in the U.S. In laymen's terms for HHG- get your domestic tonnage off before you cross the border.

You can with a Intransit Manifest.

This is true, I stand corrected. I forgot to mention taking the necessary procedure for this step.

So then, let me ask you this about a possible scenario....

Can one be based in the US as an o/o, but be leased to a Canadian carrier based in Canada ( or, conversely, be based in Canada oneself, but be leased to a US carrier based in the US ) ? In that event, can one freely pick up & drop freight anywhere in the US / Canada, irrespective of which country the freight originates from ?

That would make a head ache of a scenario...

The "cartage" law has been bi-passed, by several Canada and Mexico based carriers, by those carriers either buying up American companies and operating them as "Independent" companies, or by "Incorporating" in the USA and acquiring US operating authority.

There are also American based carriers that have done the same in both of those countries.

Schneider National has even made the move to China.

You can be a Canadian owner/operater leased to an American co and plated out of the states without a problem. You do have to show proof to the State that you are plated out of that are going to pay taxes in Canada (where you live) You cannot deliver between two points in the states though.(eg p/u in Chicago and u/l in Detroit on your way home) A lot of companies think you can do that little trick but if the Immigration picks up on that you won't have to worry about crossing the border for a while. They had a loophole for repositioning trailers IF you had a dedicated run but you had to have proof and 99% of the guys that were doing that were not on any dedicated work at all.

I don't drive for Schneider but I did get one of those preplans. When you take into account the HOS issues and the fact there is no piss break between the Aleutian Islands and the Sea of Japan, I didn't think it was worth it.
