Uturn, thanks for the reply. I was able to convince them that the letter from that nurse didn't mean much, but they DO want me to do a standard medical assessment, although I'm not sure what it's called.

Yes, Freebird, Roger's still in charge of training. I've been trying to keep this whole deal anonymous, but he's the one. Your thoughts on the new driver are close, but remember I'm a trainer, and they don't give these condos to new drivers! it's actually a trainer and his new student coming down to get the truck. Seems like a decent guy, and he'll be here tonight. I plan on photographing everything when they get there....but we'll see...

Well, it went pretty well for the most part.

They didn't get here until about 8:30, and they were pretty nice about everything. The trainer and I talked about a few things, I told him about the securment equipment that was in the truck, etc., and then he followed me up to the truck stop to pick up the trailer.

He wasn't happy about having to go this far to get a truck, as he was switching from flatbed to van, and needed a different truck...seems that mine was the only one available. I'm upset about all of this, but regardless it's not that driver's fault, so I tried to be as nice about everything as possible, even to the extent of driving out to the airport and taking them back to the truck when they returned the rental car. Probably won't see a dime for gas from the company, but sometimes a little goodwill goes a long way...

My next step will be to go to the VA and see what kind of financial assistance I can get, as this BS is really costing me a lot....

I insisted that I could drive it to the Gary, IN terminal for them...but they wouldn't hear of it, as I'm not "safe" to drive!

Because I made a point of insisting on driving it in, they can't stick me for an abandonment...but this entire thing seems senseless! I'd think it would cost them more to get the truck, then get me back up to a terminal to get another one in two weeks...

This was the training dept. head's decision to "recover" the truck...seems as this is one more thing he's doing to try and run me off...... :x

On edit: The case manager at the VA that I've been working with checked with a patient advocate, and supposedly what they've done to me is illegal. They referred me to a lawyer, whom I left a message with. Hopefully they'll get back with me...don't know how that'll work out...

Repete, thanks for the advice. When I clean out my truck tonight, my wife and I will photograph every inch of it, to make sure there are no problems with that....
When whomever arrives to "recover" the truck is ready to leave, present him with a "receipt" for the truck...don't let him leave without signing for it and the condition of the truck. Give him a copy of his signed receipt!

You can make one up on your computer in just a few minutes. All it needs to have is a place left for the drivers name at the beginning, and then your and his signature at the bottom.

Fry the minds at Roehl.

Wow...Tom you really need to listen to OrangeTx--- everything I've been reading so far has been above excellent advise--- he really knows his-CYA.

And you might as well-- give up on training for Roehl-- that prick has it in for you. Usually when they say you "talk" too much-- it's code for they think you'll train the "newbies" in CYA and other such-- non company approved "experience" or give them ideas that they could use to "rock the boat". The other poster that suggested the minute you accused them of an "illegal" activity-- they put you on the "starve out" list. Always, learn and review the DOT qualification medical regulations-- before opening your mouth about any physical or medical "temporary" condition you might be having.

Of course, this will get the recovery driver fired later down the line sooner if 1. he returns to the terminal and shows it to anyone in any office on site or later 2. Tom decides to sue or anything along those lines dealing with said truck...
However, I think it was an awesome suggestion & I would still do it if I were in this particular position
In the perfect world, none of these things would be an issue. Unfortunately, in trucking it seems that a lot of bad things happen to good people. In my opinion, these people at Roehl are power-tripping; the liability issue is minimal to them.
I've heard the larger carriers don't want you if you're willing to tell the truth too much  Apparently, they're afraid you'll be willing to tell the truth to DOT - someone who can separate them from their profit - all because they (DOT) had a short, seemingly unimportant conversation with you.
Tom, I wish I had something inspiring to offer you in the way of advice. I'm sorry this is happening to you. Isn't it hilarious, though, how people are so willing to get rid of someone, literally turn his/her life upside down, knowing that if it were them in those shoes the world would be so *unfair* all of a sudden? It trips me out. Sometimes when one door closes, we feel that the world is gonna end.. but I don't think this is a loss for you. I think it is a sign that you deserve better. I agree with whomever advised you to keep talking with Schneider, see a specialist about your injury, and take a gazillion pictures of that truck!! With tank being a specialty, I cannot see how you could go wrong. I wish you the best of luck in your endeavors.
Right on... the really hilarious but sad part is--- these " middle management" upward mobile types who are so "gung ho" about their rotten to the core employer--- after years of faithfully sticking it to the little guys to get ahead.....end up with a $25.00 gold painted pocket watch and are "downsized" themselves just prior to being able to collect THEIR retirement.

It's a little late for this advise-- but had it been me-- the minute things got really "dicey" with roehl and you were home with the equipment and they " revoked' your authority as an Agent of theirs-- i.e. no dispatch no safety clearance...but limbo-ville.... (1)-- I would have requested Roehl send you written letter-- stating exactly what your current employment status was.
then on that same day-- called the county sheriff to come out to YOUR property and fill out a report that the equipment was secure, intact, and above all-- IN YOUR POSSESSION-- and if that letter from the company stated you were still responsible for that equipment--- there would be no worries about latter being "charged" for abandonment.
Now, if the letter said-- you're fired!-- you still call the sheriff to make out a report--- only now, you've been let go-- while at home-- and the equipment is taking up storage space ON YOUR PROPERTY/Secure -- Pending recovery by Roehl. And if they owed you any money-- you should have gotten a lien against it.
When the other Roehl driver arrived to pick up the truck-- the sheriff should have been there-- to varify he was authorized to take possession.

Very good points here...

They did send me a letter, stating how I was on "Dispatch Hold"...because they supposedly learned that I did not meet their medical requirements...

The letter stated that I have a 30 day period to meet their medical "qualifications"....so we'll see...

I have given serious thought to just leaving he training department and getting away from all of these problems I've been having...but the problem here is that the ONLY reason I should EVER do that is if and when I decide I don't want to train anymore! NOT because they're pressuring me to...he seems to have been doing everything he can to get me out, but hasn't gotten a reason to do it, so he's trying to make life difficult for me.... :?

I'm just too stubborn to give in!!!

On Friday I put in an application with schneider, just as a backup plan. They have me lined up for a decent dedicated account out of Columbus. I was very upfront with them about the issues i'm having with Roehl, as I do NOT need this to bite me in the rear later on. I told her that I had to wait and see how everything works out before I could start with them, and the lady from Schneider agreed with me, and said to give her a call when all is resolved.

So, I figure, if this does go bad, I can jump right on with schneider...but that's not what I really wanna do...even after all of this, I still would rather stay here, unless I get an offer I can't refuse!

Tom,

Have you made any more progress with the fuel side? I haven't been able to do the face-to-face checking with some of the companies/drivers that I think may be of interest to you because the terminal that I load out of has been out of diesel for a couple of weeks (actually not out, a whole pipeline load was contaminated by water.) I wanted to let you know that I hadn't forgot about ya. Gary
