Being compensated has nothing to do with it. It is possible to be On Duty (not driving) performing uncompensated work, which would negate a 34 hour reset.

As far as the appeal, the FMCSA has left everything in place....for now.

Thanks, Rev. I was unsure if anything would happen. Any ideal if the 34-hour restart will be dropped in the future due to this appeal?

Last I heard, the restart is still in the house. I guess they are taking their time on this. Like Rev said, I have no idea when, or if they will drop the restart.

according to the sirius trucking channel, its done, court refused to hear the case, hours stand as is, now they are going to pursue requiring recorders on all trucks. why can they just leave us alone!!!!!!!!!!!!!!!!!!!!!!!!
