Of course twilight, you can always defend yourself. However, you would be more likely to get a successful charge against someone if you didnt fight back. Think about it, the purpose of a fight is to hurt someone. What better way to hurt someone that take away their career and money?
I dislike physical confrontation, but am certainly not afraid of it. If it got to that point and nothing else worked, I'd much rather just get it over with and not worry about anything afterwards.

Ive always wanted to ask this question to one of these tough guys who likes to fight anyone who smarts off to them. Now, dont get me wrong, in my younger days I was one of "those guys" However you grow out of it with maturity and face it we live in different times now where people press charges for anything. The question would be. Say you get in a fight with someone and he takes the punch and lays down. He then calls the cops, you get charged with assault, you lose your driving career. He has a bruise that heals in a few days, you are reduced to a 10 buck an hour warehouse person with a criminal record. Now, who won that fight? Of course I can handle people smarting off to me and shrug it off. I do it daily. What I am talking about is constant aggression and verbel abuse as the guy said he was enduring. I hate fighting and violence and advoid it every way possible. Sometimes one has to back down a aggresive bully. By the way I would never through the first punch. Leave that to the bully if he wants to continue his aggression then you are defending yourself. This is why I am getting out of my security job-I am tired of being confronted by aggresive crazy people. I hope I answered your question - just defend yourself and you won't be at fault.
