You're just howling into the wind. Truckers do not make the rules, we just follow them. Or at least do the best we can.
Like most drivers I drive illegally sometimes, but not very often. And for me to stick my lip out and say things like "By God, I ain't gonna break the law and you can't make me" is a little rediculous, as well as being a little selective. Silvan already told us that he breaks the rules now and then, but now he suddenly wants to lecture us all about how we can't be made to do this and that.
Just do what you can, get along when you can, serve your employer well, and enjoy the job.
I got caught in New York once being over the 14 hour rule as well as the 11 hour rule. The DOT officer made me sit on the lot for eight hours, is all. No fine. No ticket. It's just not that big a deal if everything else is in order.

Orangetxguy, Ihave been driving for 13 years and I have lost count of the number of times I have seen drivers trying to pull the "I'm out of hours you can't make me move" gambit. They lost each and every time.
Property rights are sacred in this case, as well they should be.

You were lucky if you didn't get a fine. Most states will not only force you to sit, but give you a nice fine to go along with your rest.

And I'm saying that you are being selectively beligerent, and encouraging others to do so.
You already told us that you have operated illegally; we ALL have gone over the speed limit on occassion; but in this particular instance you want to get your back up, hiss at the people around you and tell 'em that they can't make you do anything illegal.........horsepooky, you're just being beligerent. :?

You're right....I guess it just depends on how it all came about.
In my case I had only slept for 7 hours. I told the officer that I was just laying there in my bunk awake and decided to just "get up and do it". I logged it just as I had done it and he seemed to appreciate that.....and all my mileages and times in the previous 8 days were in order.
But I wouldn't count on another break like that one.

PS......for those who are not familiar: If you do not spend 8 continuous hours in the sleeper, then ALL that time is wasted and is counted as time on duty. That's how I came to be so far over hours.

I don't know...maybe its just me......but I would plan well enough that I would not run out of hrs at the shipper or receiver.

Nine times out of ten its totally out of your hands. You can plan till your blue in the face and in the end its not going to do much good.

Consider this: If you run out of hours, as in your 14....what it means is that you cannot log driving on line 3... but there is no prohibition to continuing to log on line 4. The FMCSR's state that all stops within the same town or city can be logged on line 4.

So, if you are caught in this dilemna....you have two options. Request an escort or stay on line 4 and log it as a "local move", and it wouldn't hurt to note "seeking safe haven" ...

I had just this same thing occur recently, and I showed myself on line 4, moved to the very first safe parking place, went off duty and started my 10 hour break. My terminal manager was made fully aware of the situation.

Personally....I found the "answer" on Ole Blue...well, useless. It wasn't even an answer. You can plan your trips until your head explodes, or the cows come home....and allow plenty of time for everything...but if a shipper or receiver drags their feet and burns off your 14, there is absolutely nothing you can do about it, beyond a best case attempt to CYA.

It's not selective, it's growing a set of balls for once in my life.

I'm simply not desperate enough to allow someone else to push me around anymore.
