No, it wasn't clear. There were vehicles in front of you that prevented you from clearing the RR tracks.

You can try one of those services that are advertised in the trucker's "magazines", but I think you are fighting a losing battle here. You've already been convicted of it. You would have to convince the judge to re-open the case on appeal. Not likely to happen.

Actually if he appeals the the case, it has to be re-opened ,look at all the deathrow inmates who abuse the appeal system.

Yes, you were at fault. The citation was correct. You should have waited until the intersection was clear in front of you before proceeding forward over the railroad tracks. Since there was a car there (which happened to be a cop), then the intersection was not clear.
BINGO, just what I thought as well, should stayed on white line until all traffic is cleared, then if it turned red, uhh you would be first in line to go next green light... plus the copper would of been long gone, hate them bubblegum machines in front of me, I can see them staring back at me..

not really if thats all you have on your record your fine. most companys want 3 or less violations in 5 years. I really doubt that you could do anything about it now. when did the light turn red. before or after you entered the intersection. if the light was green when you crossed the apex of the intersection (usually the corner of the sidewalk or where ever the white line is.) then you where in the clear. the burden of proof would have been for the officer to prove that you had entered the intersection after the light had turned red. kinda hard to do from in front of you in a moving car. had you asked this question 8 months ago we could have helped you out. I really wouldn't worry about it though.
