I have had 4 overweight fines this year and they all were written against the company and paid by the owner of the truck. and before you ask, I drive a dunp wagon, we have a certain haul were they guess the weight when they load it and then weigh in when we get to the other end, sometimes they guess right and sometimes they dont. dot man told me overweight fines go against the company, not the driver, it will never even show up on your record. last week one of our drivers got a $1600.00 ticket because he forgot to put his tag axle down, clearly his fault, but the ticketr was issued to the company, the owner paid it and said be more careful, you gotta love a boss like that.
