I would think, from a legal standpoint, that the school you attended would not be under any obligation to retrain or retest you unless they had knowledge of the violations of the 3rd party tester before you tested.
As I stated earlier:

"what happens in Sikeston, stays in Sikeston"
That was told to us, (a group of 5) by an instructor from C1, as we were driving down to Sikeston.

Default UPDATE

I had a very heated conversation today with the head of C1 (no name) and he stated "I'll get hold of finance and we'll see if we can't discount your loan a few hundred" I told him I would only accept a 100% discount. He laughed in my ear. BTW he only called me after I sent the following email:

MISTER NAME,

For the past several months, I have, or my wife has, tried to reach you by phone. The last time being today about 3 hours ago. For whatever reason, you refuse to call us back. If you think I am going to go away, you are sadly mistaken. I do not understand why it is you and C1, think you have no culpability in my license being suspended by my home state of WI. With 18 months OTR, I was ready to look for a local job, but, when my license was suspended, I had no truck in which to re-take my test. Now, no company will touch me because of a license suspension, through no fault of mine. It was you, not me,who contracted with the third party tester in Sikeston, MO. And, even though I was not one of the many who were passed through without a proper exam, I am being made to pay. Not only do you refuse to call me back, but, you also refuse to return the phone calls of my attorney NAME. I am giving you one last chance to contact me. If I do not hear from you within 24 hours, I will take the necessary steps to compel you to talk to me. In the beginning of this fiasco, of which you are 100% responsible, I was merely content to not pay the fees to your company. Now, since you have taken the stance of refusing to contact me, I am exploring legal avenues seeking monetary damages against C1. I will set those wheels in motion if I do not hear from you.

Good job! they defrauded you snd caused you damage and lost wages, you should persue them to the full extent. Its hispicable that this happened and im behind you all the way!

Had I received such an e-mail my first thought would have been this guy is bluffing. Why you ask? Simply if he had contact an attorney the attorney would be making all contacts, either by phone or mail.

From what you have written I would think you have a claim. That being said you have two options. (1) Tf the total amount is less than $3000 you could file in small claims court. (2) Use an attorney and have him/her handle this matter and let him/her decide the best way to proceed.

standing on principles? yet in your previous reply you admitted to watching people not have to take the skills test to pass?

why didnt you report them then? the state probably would`ve helped you in attaining your cdl, but now that they got shut down and it bit you in the ass your "standing on your principles" :roll:

Brian, I cannot say you are wrong. I should have reported them and certainly wish I would have done so. I guess I was intimidated by the "what happens in Sikeston, stay's in Sikeston" warning we were given. No excuse except that after 3 weeks, I just wanted to get the hell out of there and get home for Thanksgiving ops:
