If I remember right the Swift in house testers sorta skipped giving the skills portion of the test.

With 5000 drivers involved, nationally, I would suggest that they get together and initiate a class action. Yes, by all means, include the lost wages, the extra expenses of travel to testing facilities, etc. And, considering the fact that when a plane crashes, even the companies that make such things as cabinet doors are included in lawsuits, I would include Dave Berry as well. There is not good reason to leave him and Swift out of it. Is there a web site where the drivers can start getting together? If not, create one. Start one. How many weeks of lost wages are involved? Then, with punitive damages, how much can each get? Other walks of life have this available, why not drivers too?

"Swift Transportation, for its part, has acknowledged the raid, and the subsequent shutdown of the testing facility run in partnership with the Tennessee Department of Safety, although a driving school in the Memphis facility is still in operation." I'm guessing that the partnership is at the root of all the shuttin' up going on here. Has anyone else noticed which partner isn't talking? Now, for my predictable defense of Swift, I offer the following (from the landline article): "Nearly one year ago, a third-party CDL testing center at a Swift Trucking facility in Memphis was raided by the FBI’s Joint Terrorism Task Force, the U.S. Department of Transportation inspector general; Secret Service; Bureau of Alcohol, Tobacco, Firearms and Explosives; Bureau of Immigration and Customs Enforcement; U.S. marshals; Federal Motor Carrier Safety Administration; and Tennessee Highway Patrol and the Tennessee Department of Safety." That is a lot of firepower. It is extremely unlikely that posse rode into town on a hunch. It takes "information and belief" to get that kind of crowd together. For Swift to have survived a raid and that degree of scrutiny, then to emerge SQUEAKY CLEAN speaks volumes to Swift's integrity and the integrity of the program. But what about the xxxx thousands of Drivers? I hear the screeching! I feel your pain. Partnership. My guess is that Swift was doing exactly as it had been told to do by it's partner, the State of Tennessee. It wasn't just "some of the tests". It was all of them. There must have been a wrench in the works from day one to day last. As for a lawsuit? My best guess is that OOIDA is looking into it and, my last guess for tonight is the BigDOT forced this horrible "solution" on the State. So, who are you going to sue?

I originally got my CDL from CRST back in '04 if that means anything.
When I was with the mentor for six-weeks when I started out with Swift, I learned more from the mentor there than anyone at the CRST school. The rollover was all on me, but I never specifically admitted to anything in the crash that would make me look even worse. I'm still contacting Swift every now and then to get an answer as to what they had discovered that caused the accident. They're acting all "hush-hush" as to what their version of the story is. Regardless, I'm hanging onto my license for the near-future and I'll just concentrate on security work to pay for school. Gubmint says I make too much to qualify for aid anyway.

We can't get any straight answers on anything about what went wrong w/that school but it doesnt matter- just trying to get the husbands CDL back on track; all he has left to do is take the road test, which he can't do until next week- so, he has lost 2 weeks of pay, and I doubt he will ever get reimbursed, but whatever.

I've been looking online to see if there is anything about a lawsuit about this. I've found a couple of things like missing payments for loads completed, and a whole lot of complaining about having to retake tests, but so far, no lawsuits.
Rip-off Report: Swift Transportation invalid cdl Pheonix, millington Tennessee I did find it listed as a "fraud" against students, so I would believe there is/will be some kind of legal recourse.
