Hey Rev, do you think that if I polish off a 1/4 gal. of McCormick's that I'll be under .04 and be fine going to the store?
Drive your POV instead of your CMV and you won't be limited to .04.

Ummmm......anyone who holds a CDL is limited to .04, no matter what vehicle they are driving.

Here we go again..... quote me the reg, Rev. And while you're looking, check out Table 1 to reg 383.51.

Happy hunting.

Hobo, Rev. is right. It was one of the first lessons in CDL school. Even if driving a personal vehicle .04 is the limit. I can't cite the reg, but it is in the IN driving manual. It was actually one of the questions on the general knowlege test.

I finished the night with 1 Busch, 4 23oz Budweiser drafts, 1 shot of Jameson Irish whiskey, 6 hot chicken wings, several deep fried mushrooms, and a few onion wings with a cajun ranch sauce. I'm waiting for the heart attack to occur.

Golfhobo is just showing once again that he is incapable of reading the regulations. The table that he cites clearly states that if a CDL holder has a BAC greater than .04 and is driving a CMV, he will lose his CDL for a set period of time (1 year for the first offense). It goes on to state that if the same CDL holder has a BAC greater than .04 in a non-CMV, they won't lose their CDL. Since I stated nothing about losing your CDL, he is citing irrelevant regulations.

No. I am the master at it.

The table that he cites clearly states that if a CDL holder has a BAC greater than .04 and is driving a CMV, he will lose his CDL for a set period of time (1 year for the first offense).
Correct.

It goes on to state that if the same CDL holder has a BAC greater than .04 in a non-CMV, they won't lose their CDL.
It states NOTHING of the sort. It states that if a CDL holder is convicted of a DUI "under applicable state law" for ANY driver, he will lose his license for 1 year. State laws for POV's are mostly set at .08 BAC. (but you can be convicted at LESS.)

Since I stated nothing about losing your CDL, he is citing irrelevant regulations.
Colts Fan erroneously made reference to a .04 level in what I "comprehended" would be a trip to the store in his POV. YOU made reference to the same limit, as opposed to correcting him.

I pointed out the difference.

YOU then made the assinine comment that all CDL holders were limited to .04 regardless of what type of vehicle they were driving. (which implies that you obviously don't understand the regs.)

I corrected YOU and asked you to quote the reg.

You declined to quote the reg..... because you CAN'T!

Now, Colts Fan is saying you are right, while YOU are backpeddling on your statement.

I covered this issue once before with HWD, and quoted NC Statutes to back me up.

The .04 limit applies ONLY to when driving a CMV. In your POV, you have all the rights of any other driver, and must be convicted of DUI in your POV under the limits of your state to lose your CDL for a year.

Look at the convergence of line (3) and collumn 3, and you'll see the words "not applicable."

Yeah, I ruined your little "conversation" about going to the store for more beer. But, I did so in the spirit of ensuring that WE drivers KNOW and understand the rules that apply to us.

Colts Fan: You are wrong.... because the Rev was wrong. You must have misunderstood whatever you read in your CDL manual/test.

Carry on. Catch a buzz. Go to the store for more beer! Just don't get a DUI in your POV under the limits for such in your state.

Now.... Rev..... THAT is a thread recap! And I got 3 PM's asking for one! Can you prove I didn't? :lol2:
