Luck being on my side, the guy also used his "Pilot Driver Payback" card somewhere in this transaction. This info is owned by Pilot and the manager gladly gives it to me. So now I've got this guys name, personal info, and the company he drives for. Now I'm just waiting on a call back from his company so I can get his phone number to ask him a few questions.

The moral of the story? Don't throw out your nasty piss bottle on the road because a short-tempered cop might step on it and track you down :twisted: . Plus, it's just plain nasty as hell.

So unless the short-tempered cop actually witnessed said trucker actually littering, you can't really do much about it.

A) You could've gotten it out of a trash can somewhere.

B) The guy may have pulled over for some reason and it accidentally fell out.

C) Maybe a garbage truck that picked up the trash from the dumpster somewhere lost it going over a bump.

D) You could've picked up a random EMPTY bottle and pissed in it yourself.

E) Trucker may have bought the bottle for someone else who pissed in it then somehow placed it on the side of the road.

I know if I got a phone call from a cop about something like that, I'd laugh, then hang up on him and wait for a ticket, or summons, to show up in the mail. After that, I'd fight it in court, and most likely win, since the cop has no proof of how he acquired the bottle.

Well, maybe unless your finger prints are all over the bottle and your DNA is inside the bottle.
Then you can laugh, and pay a good attorney $5-10K to defend yourself in court.
If you have it to waste (no pun intended) no big deal then.

I know some truckers aren't too bright. But come on..... You actually think we are supposed to believe this :dung: story?

Honestly, how hard is to pay attention to what your doing? Don't step on the piss bombs, they are not that hard to see.

There are a lot of ways your fingerprints can end up on a bottle.
I worked for Pepsi as a delivery driver for almost a year, my fingerprints ended up on thousands of plastic bottles.

Again, we go back to the thing about how the bottle was acquired in the first place. Just for the sake of argument, we'll assume that the crime lab could be bothered to dust the bottle for prints and run DNA tests on it in between all their REAL cases. Now, once it goes to court, the driver can claim that it fell out of his truck when he pulled over. Hell, the driver could've done something stupid, but not necessarily illegal while driving and the cop saw him, followed him to a truck stop / rest area / etc. and while the driver was gone, went into the truck, grabbed the bottle and took it.

There's a thing called Burden of Proof. Yeah, his prints and DNA might be on and in the bottle respectively, but did the cop witness the guy throwing it? Are there any eyewitnesses that saw the trucker throw it out that can verify the company, truck number, and the actual person driving at the time the bottle was supposedly thrown out?

If not, the driver had his time wasted for no particular reason.
If he can, great, then the judge will fine him whatever the maximum penalty there is in that jurisdiction for LITTERING. Because, all in all, that's exactly what this is...a power tripping cop who wasn't paying attention where he was walking taking extreme measures for something that will never amount to anything but littering.

Oh, and a waste of resources in addition to littering. The exception being that this guy lives in some backwoods redneck town and they have nothing better to do.

As for spending $5k - 10k on a lawyer? You bet your ass I would pay that...right out of the settlement I would get for filing a Malicious Prosecution suit along with any incidental damages such as having to take time off from work to be involved in a frivolous lawsuit.

Regardless, it's all a big steaming pile of :dung:

Why be a lazy pig and throw them out the window in the first place.....put them in a garbage can at a fuel stop.

Littering, yes. But...

In addition, it is illegal disposal of hazardous waste, which btw carries a HUGE fine and possible jail time.

This all sort of proves the point, why go to all this trouble, expense and waste of time for a bottle of warm pee? I think most everyone will agree that when you get involved with the “justice” system the only winners are the lawyers, and the courts. As far as suing them, even if you are able to sue them, (depending on the state and jurisdiction,) good luck trying to collect.
Why not put personal excrement in the dumpster or a trash bin and be on your way. Only takes a few seconds.

I know why they toss them. Get DOTed with a piss bottle and they can nail you on no placerds/ transporting haz w/o a lic. OR so they told me when I went to school and ori. SO toss the bottle or chance a DOT and fine.


NOT saying its right but damed if you do and damed if you dont type thing and they are making their choice.
