Default Running under anothers authority temporarily

Can any body answer this for me? My brother is waiting for his authority to be approved but until then is wondering if he can run under mine. I have called FMCSA and the local ports out here in Colorado and they are not leading me to any decent answers. Like I say we are out in Colorado running flats and he has his insurance and paper work filled out and turned in just awaiting it to show up on the SAFER web site. If any one can help that will be great.

Back in the day we used to call that Trip Leasing(Prior to deregulation).
How long do you figure for him to get his authority? 90 days or so?

I am pretty sure that he only has a month to wait at the most. However I have a pretty good paying load ready to go any day now and my truck is to busy to get to it. One of our local buddies that drives in town and has for years tells us its as simple as writing a letter giving my bro permission. I just can't believe that it is that easy because nothing is that easy with the goverment.

This is one area of the FMCSA that I am not very familiar with but I would think that you would need to follow the same procedures and have the same documents in place that all companies have when they lease on an O/O.

I imagine OOIDA or the FMCSA and they could tell you for sure but I would imagine that you would at the very least need:


A copy of a current DOT physical
A "pre-employment" drug test on file
A lease agreement that conforms to the FMCSA regs
A copy of a current annual inspection of his equipment
Some type of application on file and a 10 year work history
List of all violations within the past year.
Copy of logs for the last 8 days or a statement saying he has not worked in that time frame or of the hours that he has worked.

yeah-I'd contact OOIDA or call, or visit, the DOT and ask. You asked a good question.
I wouldn't feel TOO Comfortable with him just having a letter with you though.

Too bad that we don't have the Old Trip Leasing days(Perhaps we do and people aren't doing it anymore). It was a Pain but it worked.

Uturn is right, pretty big pain in the but for a short time period.
