The only time I have ever seen it illegal to pass on the right is when the right hand "lane" is the shoulder/breakdown lane.

I dont like passing on the right, eventhough in most states it is legal...'slower traffic keep right' doesnt mean 'no passing on the right' eventhough i think it should actually say that.
I usually flash my brights to alert the driver of my approach and hope hes not an egoist that will stay there because 'its my truck and ill drive it how i like'. Ill call on the cb and ask nicely, but if i dont get a reasonable response and am tired of doing 55 on his 6, ill pass on the left... Passing on the right is dangerous in my eyes.

Uturn is right - to an extent. While some individual states MAY have a law regarding passing on the right, there is not FEDERAL law that makes it illegal.
I would pass on the right at a reasonable speed.

If the person in the center lane isn't keeping up with the flow of traffic or speed limit, its legal to pass on the right, granted you don't do so at a speed over the speed limit.
You should be to the right anway
