Default Exempt commodities & claim against broker's bond (ruling 119)

Exempt commodities are not exempt from having a claim submitted against the broker's bond if broker fails to pay a carrier for the load. Exempt commodities listed in the ruling 119 are exempt from having/needing the MC authority. It has nothing to do with the broker's bond or bond trust. That's what the FMCSA and the local Federal Field Office explained to us. In our case, the broker has already been paid and we've verified that with the buyer directly, but the broker hasn't paid us for over 60 days now, the carrier. The broker's bond, though, is referring to the ruling 119 as a proof that they can't process a claim against exempt commodities. Any feedback on this???

That sounds like bull****. You have done the job and you should be payed. And all these exemptions are about the licensing, but not about the insurance. Seems you can sue them easily.

I was told once I coudn`t file a claim against a broker because the load was picked up and delivered in the same state and didn`t cross any state lines
any old excuse will do when they try to shaft a trucker it seems
