I took this off of the FMCSA website. I think that based upon their definition that a dispatch service would not need broker authority unless they are also brokering freight. The dispatch service acts in behalf of the carrier. A broker acts in behalf of the shipper.


Definition:

Broker means a person who, for compensation, arranges or offers to arrange the transportation of property by an authorized motor carrier. A motor carrier, or person who is an employee or bona fide agent of a carrier, is not a broker within the meaning of this section when it arranges or offers to arrange the transportation of shipments which it is authorized to transport and which it has accepted and legally bound itself to transport.

I should have been a clearer in my statement about dispatching service with regard to also brokering freight. I consulted with transportation attorneys when I was thinking about performing this service.

Well yes, if you were going to broker freight as well, then you would need a broker authority. Wouldn't have argued with you at all on that one :lol:

Maybe a stupid question, but getting the carriers to lease onto to this guys authority, well who's going to find the loads for the leased on carriers? If they are going to get it own their own, why wouldn't they just get their own authority?
