Default Did the right thing but got screwed..

Little back drop to the story here.. I've been working for this company for over 2 years never missed a day one. I've went above and beyond helping these guys out taking run's when no one else would etc etc.. So pretty much all this year Intermodal work has been real hit and miss 70hrs one week then 2-3 weeks of barely 40hrs a week. I started looking for something that would be more steady and got hired on with Foodliner hauling a pneumatic tanker. They asked me when I could start and doing the right thing said I gotta give 2 week's notice to my current job they said that was a good answer and put me down to start after those 2 weeks. Well I went to my current boss and gave my 2 week notice. They said ok no big deal... yesterday morning I was approached by both current boss's and was told that my 2 week's notice wasnt needed and yesterday would be my last day. Only 2 day's into my 1st week so here I set without any pay for pretty much the next 2 weeks. Im hoping that foodliner can get me started next week instead of the week after. Just show's how a driver is treated after year's of dedication when they find out your going else where.

Some companies are that way.As long as they can benefit everything is cool.When they see they no longer can benefit from you,throw you away and the next driver will come in. Wish you luck with your new company. I drove a pnuematic truck for awhile until this particular company lost several customers. I loved pulling one. I hauled calcium.

They can't fire you for quitting. Take them to small claims court and sue them for your lost wages. Call your new boss and tell them what happened. They may start you right away.

Griff, sorry to hear about how they did that to ya. I would go to Foodliner, and tell them what happened. I would ask them if they can start you asap. I would explain that they (former bosses) let you go, without allowing you to finish out your 2 week notice. 2 weeks without any income isnt easy.

Glad to hear you landed on your feet with the new gig.

Of course after seeing this happen how many other employees of your previous gig are going to give 2 weeks?

Another option in this scenario would be to claim unemployment for the 9 days that you don't have work. You get paid to sit at home and catch up on honey-dos or enjoy quality time with the Xbox.

That's good, Griff. Glad to hear it. Most of the time, companies would like to start you asap, but they normally allow you to put in a 2 week notice at the job that you are leaving. Looks better on paper. Some dont care. Good that they went ahead, and got you started.

Any employee who is not covered by a contract is an at will employee and can be terminated for just about any reason. They do not have to continue your employment once you have given notice.

Filing in small claims court would not gain you anything other than losing your filing fee.

You can be terminated for anything. I worked for an electronics company years ago and I gave them my notice, and they canned me that day. They'll make up some kind of lame excuse but unless your are Union or contractual, you have no legal recourse.

Just leave on a good terms as to not burn your bridges should you need a recomendation later on.

For the most part and for most of the companies that I have dealt with, they require a two week notice when resigning, most really will not hire you back without that. BUT most of their literature will tell you that while the require a two week notice, they do not gaurentee that they will not wave the two weeks and give you an immediate release. It's up to the company really.
