I will be starting cdl school 3/12/07; and I am looking forward to a new career. I was laid off from the state of NC about 5mo ago, my department was downsizing and now it is going down. I was with them for 13yrs. At 56yrs old it is impossible to find decent work. So much for the recent background.
I have an old misdemeanor conviction for shoplifting in 1972. I was also arrested for DUI in 1981. The shoplifting I know that I will just put it down on any application. The DUI is kind of tricky. I was released on bail, I was then offered a job in another state and went there. I never took care of the charge. My question is how to deal with this. Should I just put down was arrested for DUI. I would also like to know if anyone has any idea how I would go about taking care of this legally after all these years. I had a NDR record check done and I do not have any records in my file. I had my FBI criminal background check done and I show up as released on bail. I have no felony convictions and other than couple of speeding tickets a clean record. The DUI was Colorado. Thanks :?:

Wow. I thought that if you didn't show up, they would try you in "absentia." Which basically means you'll get convicted because you're not there to defend yourself. But apparently, you're saying, according to records, that you were never convicted?
Better talk to a lawyer, kiddo. Make that several lawyers. Because if they find out you put misinformation down on an application you're really screwed.

I will take your advice and contact a lawyer. I really had forgotten about it, until it showed up on the check. I was young and stupid. I have been a better person in the years since, so hopefully I can have this thing taken care of. Thanks again

I did contact a lawyer, and you all had the right answers. The advice that I received was that I should just let it go. If I was to contact the state to clear/clean up the situation it would show the conviction as of now, not 25+ yrs ago. I was told that if the record did not show a conviction on it then charges were probably dismissed for non-participation, this was done at that time. Also the records from the DA's, Court and Sheriff offices have most likely been purged by now. I was told that if I was specifically asked about it that I could say that the charges were dismissed and it would be pretty hard to prove otherwise, since that is basically what did happen. I am not so sure that if the situation were to take place today with the way computers are used in law enforcement that it would play out like this. Anyway it looks like things will not be as bad as I had thought. I would really have been disappointed if something done that long ago would have come back to haunt me.
