Actually, several of your points are incorrect! You need to read the post and the previous post again! That pass has signs at the bottom and about half-way up, the states to use the shoulder if you cannot maintain your speed!!!!!!!
Do not remember the exact wording, but the signs are there! The state engineered the shoulders for trucks that could not maintain their speed. It is obvious from the video, that the dash cam truck was well below the average speed of the rest of the traffic on that grade! Thus, the lane he should have been in, would have been the shoulder lane! Thus the far right lane! Slower traffic stay Right!!! You can verify my post regarding Texas Law, by looking it up! Texas has gone through extreme effort to make sure the laws of the state are available to anyone that wants to read them! The DA should have been in the shoulder lane since he could not maintain speed, and thus impeding the flow of traffic! My comment on him moving to the left lane, was in reference to the second time, not the first! When he was attempting to cut the flatbed off from passing the interstate truck, or at least that is how it appeared to me!

The DA was the one with the dash came doing much less than the speed limit, and failing to yield to the trucks that were pulling the hill at speed! There ARE signs posted on that stretch and many similar stretches around the country.

And then, to speed up and block the left lane again, so the other trucks and 4 wheelers could not pass him!
And what his wonderfully edited film does not show, is he was more than likely playing CB Rambo before this happened. Hypocrit!

Ignorance is bliss, and the video proves that there were two ignorant drivers on that stretch of roadway, at the same time. If there had been an accident, and the driver with video running, had shown said video to a LEO on scene..he would have received an appropriate citation. Im just sayin... Through-out Oregon you will see signs encouraging "slow vehicles" to drive on the shoulder of the roadway, while climbing certain hills. Those signs are on I-5 and I-84, as well as on US 97 between Kalamath Falls and Bend, on US 26 between Ontario and Burns, and between Burns and Lebanon Junction, as well on several other state and US highways in the Oregon. Will OSP site a driver for not using the right shoulder? I'm fairly certain that they will, if you are blocking traffic, and others do what the COT truck did in the video, in an attempt to maintain their own speed. Am I saying that what COT did was right? NO I am not. What COT did was unsafe and ignorant. I have a bigger problem with Mr. Videographer cursing when HE see's the COT truck passing him on the shoulder, then ACCELERATING while the COT truck is clearly beside him, traveling at a faster speed. You can clearly hear the Videographers engine increasing in rpm's in an attempt to box COT onto the shoulder at the summit and beyond...then Mr. Videographer chases COT down the road...simply because he himself is having a case of "road rage". Once that driver saw COT passing on the shoulder, he should have either maintained his speed, and moved LEFT once the lane was clear, or decreased speed while holding his position in the right hand travel lane. Either of those options would have been the safe responce to COT passing on the shoulder. What Mr. Videographer did was un-safe, and had the potential to make an unsafe situation into a major accident. Everything after the curse, was "Road Rage" and in Oregon that is illegal. That is what I saw in the video. I emboldened BD's "Smith Hill" portion, because that is where I believe the incident took place...on the North-bound lanes of I-5.

That was a stupid pass that saved the driver no time at all, Period.
If that is the norm, as you suggest, I think a little enforcement is needed :shock: I bend the law all the time, but I do it without endangering others.
