Default Pepper Spray

Is Peper spray considered a weapon under the DOT? It is hard to get a stright answer. I have been thinking of asking a DOT officer next time I have to talk to one.

DOT = Department of Transportation. Exactly, what do they have with weapons?

I thought it was the DOT that made the rule that your not allowed to carry weapons in Comercial Vehicles? But I am not sure, but IF I were to be searched by the DOT, and they found peper spray, could I be in trouble??? I might be wrong there, but there are laws against carrying weapons in trucks. But what is a weapon? Anything can be a weapon.

I know the FAA decided that pilots could not carry firearms and disarmed them in 1987, that was a great idea, now wasn't it? I sure wish to god we were allowed to carry firearms (considering we qualify like any other CCW permit) It would stop a lot of the bs we have to take. I gaurantee there would be a huge drop in truckers being robbed. Also agressive lotlizzards, and other problem people would think twice before banging on your door. Remember, the law breakers are already carrying and the one's that don't because they are afraid of being caught, wouldn't qualify, but for us law abiding one's, it would make a huge difference.

There is no federal DOT law against carrying a gun or any other weapon in your truck. There are, however, a myriad of state laws that you would have to contend with. The DOT(state or federal LEO's) also has to have either permission or a warrant to go through your personal possessions. Don't ask, don't tell.

I always thought that commercial vehicles were subject to be searched at anytime with no permission or warrant?

Law enforcement may conduct safety and cargo inspections at any time. Searching through personal property is a different matter. They can ask, you can refuse, and they can then keep you right where you are until they obtain a warrant.

Then there is also the "probable cause" they can use to search your vehicle without a warrant.

As already mentioned though, there are so many different state and local laws, not to mention company policies, regarding what constitutes a weapon and what is legal to carry and/or use that a person could find themselves in trouble quite easily.
