Keep in mind that, there is no way of knowing WHICH person in the vehicle was involved in the text messaging, although the report seems to indicate that the driver was involved in the preceding conversation.

Unfortunately, the probability is HIGH that it was, indeed, the driver, but we don't know, and never will.

I wish someone would film a "re-enactment" of this crash, emphasizing the dangers of texting OR talking on a cellphone while driving, and make it a part of EVERY driver's education class, especially those taught in high schools.

I saw that they had this as a topic on Geraldo (sp?) on MSNBC last night. It is a shame for a parties involved. I feel really bad for the driver having to live with this for the rest of his life. As stated above it would be a great video to show in Drivers Ed in High Schools everywhere. If it sinks into just 2 kids that might save at least one of these tragedies.

According to investigators of the June 26th accident the Drivers phone was used to make a call, send and receive text messages 3 minutes before the crash. According to an indepth study on Texting while driving you are considered to have " inattention blindness" and shows that braking to be slowed by 23 percent.and 6 times more likely to be distracted and have a crash.Texting is considered to be the worst thing a driver could do.according to the National Safety Counsel.The only state to ban drivers from Texting is Washington to go in to effect Jan,1.

Even if the driver wasn't the one on the phone, she wasn't supposed to be on the road anyway. According to the article I read, which I got off of AOL, she had a junior license and wasn't legally allowed to drive after 9pm anyway. She wasn't supposed to have that many passengers either.

Sadly, enacting laws that prohibit texting will be about as effective as DUI laws and seat belt laws. The laws are there but people are still dying. What a shame (sham)......
