Default HOS Help

I have a major issue with my company regarding my HOS. I received a phone call this morning advising me that I was taken off a $600 plus load because the log clerk indicated the computer said I was over my 70 hrs. by 3 hours. I advised the log clerk this was not correct. I then spoke to the new terminal manager and he suggested that I bring in my log book and information and we would go over it tomorrow.

I've only been with this company for two months, and they keep comong up with this additional log books stuff and other information that they want on the logs. When I signed the lease I did not see anything about this additional information. They indicated that they can be more stringent then the FMCSA. It appears like this company is being more like a company driver big box company. What are your suggestions?

If I provide you guy's with my hours would you kindly help me figure this mess out? I feel as tho I'm correct and will stand my ground regarding this issue.

I'll post the hours from the first of the month. I've did the re-cap over three times and come up with the same this. It shows that I still have hours left to run. I did not have one day off, as I kept gaining hours back. I don't thing this log clerk knows what she is doing or talking about, and she would not take the time to do by hand. I don't think she knows how... it's all by the computer.

11/1 - 5.5
11/2 - 9.0
11/3 - 10.0
11/4 - 1.50
11/5 - 14.0
11/6 - 5.0
11/7 - 6.75
11/8 - 10.0
11/9 - 4.25
11/10 - 9.25
11/11 - 9.25
11/12 - 11.0

I came out with 14.50 hours left to run!

I show that as of 11/12 you had ran 69.5 hours and as of midnight on 11/12 you picked up another 14 hours. So, if you haven't used any hours yet today as of this writing you have 14.5 hours available and will pick up another 5 hours at midnight tonight. What is your company not getting?

My guess is that whatever software they are using is finding that you are not logging legally - are you logging it as you are driving it, or are you logging based upon a set speed?

The only other option would be that the person who entered in your times screwed up. Showing them your logbook would fix that problem pretty easily.

Thanks for all your help. I knew I was right!

Everything I presented here is the true hours, as I have to log it as I drive it because that's what the company wants. I can only go a half hour on either side of my arrival and departure times as they match these via qual-com.

My guess is that whatever software they are using is finding that you are not logging legally - are you logging it as you are driving it, or are you logging based upon a set speed?

The only other option would be that the person who entered in your times screwed up. Showing them your logbook would fix that problem pretty easily.
If the above is your total hours for the past 8 days as indicated (69.5) 70 being your max hours, your subject to the 34 hour Restart.. Please correct me if i'm wrong...

You are wrong, for two reasons:

1. On the next day, he would gain 14 hours when that first day (the 5th) dropped off, giving him 14.5 hours to use. He had 69.5 hours on the 12th. On the 13th, he has 55.5 hours.

2. The 34 hour reset is NOT mandatory. Nobody is ever "subject" to it.

Boy do I feel like an ass.....I've been essentially screwing myself out of driving time by taking the 34hr restart each week as that was how I was taught..............
