The comment period at FMSCA doesn't open until December 29, and runs for 60 days. By then the holidays mess is behind us. From what I've seen of it, we actually got off better than a lot of people thought we would. Sure beats 9 hour drive time with 48 hour resets, which was one of the earlier possibilities.

I like the 11 and 10 we have now, but 10 and 10 isn't bad either since I don't ever drive more than 10 in a day, but for others thins might hurt...... but just like stated, these are "PROPOSED REGULATIONS"

Everybody take a close look at the proposed changes to the 34 hour reset. A reset cannot start less than 168 hours (7 days) after the last reset started and must include two consecutive periods between midnight and 6AM. So lets say you usually get home Saturday afternoon and head out Monday afternoon but you run late for some reason and instead of getting home Saturday afternoon you don't get home until 1 AM sunday. Now you can't start again until 6 AM Tuesday. That 34 hour reset just became a 53 hour reset. So you head out Tuesday morning, get back home at your normal time this week which is Saturday afternoon and get back on track. Except you're not back on track because even though you're home Saturday afternoon you can't officially start the reset until 1 AM Sunday, 168 hours after the last one started. The only way to get back on track is to keep running later each week until it works back around to your normal time. That's just one example but I'm sure there are many depending on each persons situation.

Actually, after looking at the proposed rules, not much will change for me. I normally don't use a restart at all unless I'm at home for my normal 2-3 days off (2-3 weeks out). The only rule that seems to affect me is this one:

Limit on consecutive hours of driving: May drive only if it has been 7 hours or less since last off-duty period of at least 30 minutes

I don't take lunch breaks through the day - I stop and take a leak. But, that's not a biggie.

Also, if they go with the 10hr driving, it shouldn't affect me much either. I try to stay at 9-9.5hrs/driving per day anyway.

I can definitely see how this will be a major hurdle for regional drivers. I did that for 3 years, where you would be running very hard all week, take a 34 and repeat every week. The "midnight-6AM" thing is just stupid, though. Not everyone is a night-sleeper.

Take a closer look at the reset proposal. Basically you will be doing a 48 hr reset. it says in the new proposal that you will need 2 periods of off duty time from the hrs of 0000 and 0600. Now lets say you start your reset at 0800 on 12/26/2010 by all rights your reset will be over at 12/27/2010 at 1800 hrs. But with this new proposal you will need to sit untill 12/28/2010 0600 giving you what amounts to a 48 hr reset. or 46 if you really want to be picky.

actualy a 48 hour reset isn't the best choice. you pull over at 1800 monday and you cant leave till 1800 wednesday, esentualy flipping your schedule.

True, but for many of us an 8.75 hour a day average is not reality. And we don't want it to be either. I reset at home each week. When not at home I like to run hard instead of sitting around the truck stop for hours. If I get get home before midnight every friday there wouldn't be an issue but sometimes it's not until Saturday. It's not hard to get back on track though with a little shorter week the next time. If the 34 hour reset rule goes through as proposed that wouldn't work out too well. I can see the reasoning behind only being able to reset once a week, but like most things HOS related it needs some flexibility as it will likely mean less time at home for me and a schedule that is further from anything that could be called regular.

Other than that I see no issues for my situation.

Frankly, I see no reason to fret over anything at this point....this issue is like the "never-ending story"...it may as well be on a continuous loop.... I'm not going to worry at all about the issue until such time as I see the final rule cut, then I will just do what I am required to do.

Not going to lose any sleep over it.....nope.
