Well, that is essentially correct. However, according to the FMCSR's you were never allowed to "maintain" that CDL without medical certification anyways. In fact, you said yourself that, "that CDL is USELESS without a medical card."

It is unclear to me at this time whether or not you would be required to go to the DMV and get a "downgraded" license. I suspect you would NOT (until time for renewal.) However, your CDLIS record will show the downgrade when a cop runs your license, so you better not be in a CMV.

Not true. IF you let your CDL "lapse" (or be downgraded) as a result of not having a medical certificate on file with the SDLA (State Driver's Licensing Agency,) and you choose to reactivate that privilege before the renewal date on your license, a simple ME certificate would seem to suffice. If it is AFTER the current expiration date on your license, you MAY need to retake the written tests and pay the $100 bucks or so (depending on your state.) I saw no requirement to retake the road test, although there MIGHT be such a requirement in some states. In others, I believe your certificate of training and initial road test may suffice.

This new ruling, which was mandated long ago, serves ONLY to incorporate the need and verification of medical qualification with the information on file at the DMV. Instead of providing the renewed medical certificate to your employer, AND the need to carry a card on your person, it mandates submittal (by mail, fax or other means) of that periodic medical certification to the SDLA, so that it can be accessed by officers during a roadside inspection, and to keep the SDLA from downgrading your CDL privileges.

I repeat that, without said certification, you were not allowed to operate a CMV in "non-excepted Interstate Commerce" anyways, and therefore maintaining your CDL after leaving the business was of no value other than personal prestige anyway.

Unless, of course, you intended fraud. And that, plus safety issues, is the reason for the new ruling. Surely you aren't against keeping unqualified drivers out of big rigs! ;)

Here in ontario canada its been that way as long asi can remember.

We don't have medical cards, and don't need one to truck into usa either.
To get and keep a CDL in ontario, you must bring in a valid medical form from a DR every so many years.

And anytime i have got DOT inspections in usa, i have never been asked for a medical card, since our Ontario drivers licence proves we passed the medical or we wouldn't have that class of licence.

makes sense that usa should also just abandon medical cards and just make drivers provide medical forms from DR when applying and renewing their licence. then drivers wouldn;t need to carry a medical card along with the CDL.

That was about to go into effect when we moved from FL to IL last year. We had no idea about it, but found out when we went to the DMV that we made the deadline by three days. Doing the road or skills test wouldn’t have been a problem, but at the time we didn’t have a trailer handy and THAT would have complicated things.

According to the DMV lady we dealt with, in the future the plan is to make even those staying in the state and renewing their CDL take the road and skills test if they’ve had any at fault accidents or tickets in the previous three years. I don’t think it’s a bad idea, but as I mentioned above, if you don’t have a trailer at your disposal to test with (say you’re a lease operator leased to a company in another state that does not let you take a trailer home) it could cause a problem.
