Saw a message posted on the BB at our Kansas City terminal that 9/14 was the tenative start date for the new HOS rules. I have heard this nowhere else. What is everybody hearing? We were told no reset and only ten driving hours while still keeping the 14 hour rule.
the court of apeals tossed out the 11 hour drive and 34 hour reset. the ata asked the fmcsa to apeal the ruling but so far nothing has happen. hopefully something will be done before 9/14
I'll bet anyone a nickel that nothing changes on 9/14/07. (limited to the first 20 people to accept my wager, and you'll all have to break a dollar if I lose).
Just for grins, I'll predict that the FMCSA will ask for, and be granted, a temporary injunction while they revisit the rulemaking process. Remember, there was no ruling on the merits of the regulations, only on the process used to adopt them.
Then, down the road, we may very well see a reduction from 11 driving hours to 10 and the elimination of the restart. Or, we may see the FMCSA open things up for commentary and produce more evidence supporting their decisions, ultimately leaving the regs as they are.
Either way, my five cent wager regarding the 14th still stands.
