Default Dot Physical, Company sees your entire medical history

I have often wondered if this is legal. Every company I've gone to work for, they get a copy of, and look at, the long form from my physical.

It seems to me, that all they should be concerned with is that I passed the physical and am in good shape to drive. If they need to keep a copy of the long-form in the office for DOT audits and such, it should remain sealed.

But everywhere I've worked I've noticed them looking at my long-form when I bring it back from the physical. There isn't anything particularly that I care about them knowing, but I still don't like them looking over my entire medical history when that really should be of no concern to them.

I guess I should consult the HIPPA laws.

unfortunately you have no right to privacy in the employee/employer relationship. idk bout Hippa pls let us know if u find something.

Yeah, I guess they can know everything about us. Kind of makes me sick, in a way, but that's the way it is.

No. Records that relate to other employee benefits such as life insurance, disability, workers compensation, or long-term care insurance are not covered by HIPAA. Nor are records that relate to your employer's compliance with laws that govern safety and health risks in the workplace.

I once took a DOT physical arranged and paid for by a company that I drove for. Months later I wanted a copy of it myself. (I was not given a copy of it at the time of the exam) Clinic told me they could not provide it to me, it "belonged" to the company. I would have to get approval from the company.

they didn't give you a copy to turn in to the DMV? I usually give the DMV a photocopy and keep the original.

No, I have never had to turn in a copy of the long form to the DMV in Tennessee. I have had to show my medical wallet card, however.
