Advice Please..

There are owner operators with their trucks in other people's names..I am planning on getting the truck and need to know how to do this and make it legal..Do not need my future ex wife sticking me for my children's future college funds that I plan on saving for them...Any GOOD advice will be greatly appreciated..Thanks...T.

The thing about having another person's name as the "Owner" of your truck...leagally THAT person IS the "owner" of YOUR truck.

Pay your child suport..buy the truck and do it legal...in your name.

This is just a question but, why would you bit$h about paying for YOUR kids college for. People who hide what they make from their EX do this so they can short their kids out of money. You were there to make them, your life is over till they are raised, get used to it!!!! Why do people think when they get divorced and the kids live with the other parent the kids don’t deserve the same as they did when the parents were together?? You’re still their father so think about them first!!!!!!!!!!!!!!!!
As a father with custody of my last 2 kids, and an ex that doesn’t want to help with the cost of raising them, I hate seeing people post like you do!
My rant is over........lol

I think you all misunderstood me..I'm not trying to get out of paying child support...I have no problem with doing the right thing..I will be making around 32k NETas a driver, which they will recieve $11.200.00 a YEAR..That's not the problem...The problem is, my future ex has never been able to save a penny, no matter how much money we had...My only motive is to save the money for THEM AND THEIR COLLEGE..Because she WON'T..So please I need someone that is doing this to tell me how I can do what I have to do..Thank you, T.

It can be risky having a truck in someone else name. If that is what you want to do, all you need to do is put it in their name and lease it to you or have them give you a power or attorney as to the use of the truck. You could also set up a corporation and put the truck in the name of the corporation. The best think would be to consult with an attorney.

Gman, thanks for the reply...

And not to be misunderstood again by anyone, I am going to pay myself as a driver, and pay support off of that...The truck needs to be separate for them to have something later on...How it is figured up here in Texas, the amount of $11.200.00 will be approximatly what I pay each year at around 32k net...I have No Problem with that, whatsoever.. If I wasn't going through this I wouldn't be buying another truck...This is the only thing that I can think of to insure their future..So please, once again, I am not trying to get out of anything, my motives are the complete opposite here.. Thanks, T

I would do the corperation thing way before I would just put it in someone else's name. It will cost more, but the cost will far outweigh the risk. Say, for example, you put it in your best friend's name. He is a very honest guy and wouldn't do anything to harm you. But his kid is out late one night and causes an accident. Since his kid is a minor, your friend is financially responsible. The court could seize all of his assets, including "his" truck that you paid for and are driving. Definitely consult an attorney.

Just my 1/50 of a dollar.

Oh, and if anyone is curious, she nets around 45k a year.. So with the 11k she will be getting from me I think they'll be okay...

Hey azcardnlz, That's the kind of info I need to know and take into consideration...Thank you, Sir...Can someone tell me who to talk to?? OOIDA referred me to PBS in Cali. and they told me that it would't be a good idea unless I could show over a 50k profit...I'm not sure I can profit that much here..I guess I need to drive this truck for the owner awhile and see what it can make...That was kind of the idea to do so anyway..Thanks, T.

No problem. Under normal curcumstances, incorporating would not be the best thing for you to do. I doubt that I would even under your circumstances. I'm just saying that I would incorporate before I would take the risk of signing over my title to someone else. Find a good attorney in your area, buy an hour of his/her time, and run it past them. They might come up with a plan that no one else has thought of that might work for you. If not, they can at least advise you on these issues. BOL2U.
