PA DOT inspectors truck registration ticket

Hey All,

Looking for some help here. You see I just was cited for being overweight on my F550 and 10 ton gooseneck trailer. My scale ticket read the following

steer axle- 5180 (rated for 6,000)
drive axle- 7160 (rated for 13,500)
trailer axels- 15,300 (rated for 22,500)

They said I was overweight by 10,740 pounds WHAT!!!!!! The truck is registered for the Ford allowable 17,500 gvw and my trailer is registered for 22,500 BUT according to the officer it only goes by the truck registered gvw. SO basically they said I have to register my truck for 40,000 pounds if I want to be legal in PA. The ()^&^%$&)_(&_(^(&*%*( ticket is $1479 for this one and first ticket. WOW.

Is this correct or did the officer mess up? PLEASE HELP!

yes, he was correct, the legal weight allowed should be on your registration, if you are operating in another state, then you play by their rules, go to court and plead dumb, the judge will probably reduce it. I got one in Georgia at my last employer for $1600.00 and the owner got it reduced to improper equipment $150.00

Thanks for the quick replies. Yeah it appears as they know what they are talking about. :( Dang it! Well hopefully my screw up will open someone's eyes here and they will make sure the registration is right. :0 What a bummer.. Just when you think you are making a buck you look a load. :(

You probably got busted for being over your tagged weight. My company got busted in VA for that and it was basically the exact same deal as you Darin. We fought it and lost. They said the truck was overweight after weighing everything. Said the entire weight was over the truck's tagged weight. Our argument was that the trailer was not on top of the truck, it was behind it so therefore the weight back there shouldn't count against the truck itself. Judge didn't buy it. We learned out lesson, raised the tags to 26,000 even though the truck is legal only to 17,000. 1 pound shy of needing a CDL in order to drive the dually's. Those trucks never weigh more than 15K but we wanted to make darn sure they couldn't get us again. Remember, if you take your tags up to 26,001 or over you need a CDL, if you only go to 26,000 you don't need a CDL.

Yeah it's a bummer any way we look at it. :) I do have my class a license due to being stopped before and they at least were nice enough to warn me for heaven sake. I'm sure they hear it all the time... I didn't know that ... but this time i really didn't. :)

Uhhhhh now what the heck am I suppose to do? NY DMV doesn't give you a combination registration and the IRP program is for 26,000 gvw trucks and or 3 axle trucks. Well my truck is 2 axles and 17,500. :( How in the world is this fair and what can i do. ANYONE???

Try giving these folks a ring and explaining everything out. They could probably help you get going in the right direction.

Is the truck registered as a "private" or "commercial" vehicle. Makes all the difference.

Thanks all. This truck is for my use only. I have US DOT numbers but no mc numbers.
