beating a speeding ticket
well, i got nailed
coming down the final grade on I-5 north freeway. it goes to 45 then 35 mph. drifing along, my speed was up to 63. i didnt realize i had just crossed into the 45 zone. theres CHP waiting there for me. about a half mile or so past the 45mph signs i get a ticket , the full 63+ in a 45 22407vc anyone ever used a lawyer to beat a ticket like that. i'll be calling one. how much should this cost me in fees. can i actually beat this? til now, i had a perfect 10 year MVR  thanks, mike |
Could be considered a trap in some states but more than likely your toast. Had you not been cruising along picking up speed and been trying to slow down, you might have been let off.

There are companies who work with this type of thing. I believe one is called Road Law. Some set up booths at truck stops. You can often find them at a TA or some Petro's. They charge a fee for the referral, as I recall. The way some of them work is that they refer you to a lawyer in a particular area. They will usually plead it down to a non-moving violation or something that will not affect your CDL. You may check some of the magazines available in the truck stops or check on the OOIDA website. There was a time when California offered a course you could take which would allow you to not have a ticket appear on your CDL. That is not supposed to be the case anymore. I would find a lawyer to try and work something out. Being that much over the posted speed could cost you a job.

Must of been coming down the grapevine. Not just going over the posted speed limit, but also exceding what most CHP will allow in the 55 zones. I see it might be hard to get this one taken care of.

Don't know if it is true or not but a trucker I was running with last week is from California, he says that if you over pay your ticket by just $1.00, California will issue you a refund check. Throw the check in the trash and don't cash it. Their computer won't allow the points or the ticket to show up on your record until the transaction is complete and without cashing the ticket it will not be completed.
Like I say, don't know if it is true but if you do decide to pay it, won't hurt anything to try!!! |
I beat a speeding ticket once by simply taking it to court and the officer never showed up so it was thrown out. I probably got lucky. This was for 5 mph over though.

Why would anyone have even thought to attempt it? Why would the state of CA allow a loophole like that to even exist, because they would obviously know about it? And if it was true, why would CA allow so many incomplete transactions to remain in their computer system? |
Anyone else notice that this topic and only this topic shows an ad for beating a speeding ticket at the very bottom of the screen.
No wonder CAD has slowed 10 times the speed it use to be at. |
That's Google Ads for you. The adbots read for keywords and appropriate ads pop up. At least we don't have to worry about the ones down the right side of the page. Those were definitely a pain in the patookas.

Like I say, don't know if it is true but if you do decide to pay it, won't hurt anything to try!!! http://www.snopes.com/autos/law/ticket.asp Regarding the speeding ticket...I believe since that is more than 15over the limit 63 in a 45. Thats also one on the few CDL no nos'...2 of these CDL No nos' in 3yrs will get you a 60 day suspension Check the link: http://www.fmcsa.dot.gov/rules-regul...ction_toc=1322 This is the legal service plan I belong to...Jim Klepper is the owner, this is well known in the industry. Since you are not a member, you can still use the service, however there will be a much higher fee for the use. This is a citation you MUST have taken to court and have it talked down to a lessor offense, either a non moving violation or get the speed less than 15 over. http://www.driverslegalplan.com/ |
www.roadlaw.net friend got a 15 over in oregon and it cost him like 600 bucks to fight it but he won
|
It may be worth a few hundred bucks to keep it off your record, which could very well lead to your continued employment...of course the best way to fight a ticket is to not get one in the first place.
|
o.k. well
i talked to a lawyer that specializes in this type of thing. 600 bucks and he'll either get it dismissed or get it reduced to a non moving violation. ethically he cant make any guarantees, but he has a 90+% success rate. signed, Not Guilty |

funny thing is, i drive like a grandma out the. Swift trucks pass me. Just wasnt my day i guess. need to pay attention to those signs |
Speeding tickets are a racket...like a kind of Gov't local Mafia.
Usually if you pay them double the fine all records of the incident will magically vanish. Example...Passing on the right shoulder in state 'X' 350.00 dollars... to 'make it disappear forever' from your records .... $ 700.00 Case closed... have a safe day driver  |

Maybe a little different if you go busting through a slow town at light speed Be careful in Mo. |
I was left with the impression that if you are an OTR driver
and may not be able to make a court date... that they will 'work with you' whatever the case in order to keep things rolling. The pisser was that I was saving for a new Les Paul and things sort of got delayed for a while... Its nothing new...me and my brother got nailed as youngsters on a dirt road in Ga and paid the fine on the spot in order to avoid court hassles. Look at the bright side...these fellows are keeping the world safe... and thats what matters in the end.  |
yeah, this is going to put a bite in my financial situation too.
but, oh well its just money, i'll make more tomorrow  |

Its just the way the game is played...companies don't 'want' to fire people...the 'system' is what boots a fellow out. Good Luck to you :) |
well, i got the bill from the court. im suprised. even though i was sited for 63 in a 45 downhill, i am being charged with a 10+ and a fine of $380.
i though it would be much worse. im still going to fight it to avoid points. i will keep you posted on the success (or failure) of fighting and winning. |
I was one of the IDIOTS who got caught on I-70 in Indianapolis last year where trucks of a certain size were not allowed. The OTHER drivers who got caught were to lazy to take the detour, I DID pickup a load in Indianapolis. Which didnt matter to the cop who pulled me over when I showed him the bills. When I asked him, WHY trucks were not allowed he told me: The lanes are too small for the case an AMBULANCE would have to pass while I-70 was under construction and they had no emergency lane. I said: Good one, then why do you guys pull ALL those trucks over were there is NO EMERGENCY LANE????? (Next to me where about 10 other trucks pulled over.) I said this is just a BIG MONEY MAKING SCAM!!! I got an ugly look and he left. So I decided to fight the ticket in court. The fine was something over $200 and they didnt decide if it will be points or not. I fought it with a lawyer from the truckstops, which told me they get over 90% of their tickets dismissed. I of COURSE was in the under 10% bracket. Now the fine was ANOTHER 450$. I will make sure I wont use their service ever again!

Most of the lawyers that advertise can get it knocked down. All California, and all the other states/counties, want is the $$'s. Couple of years back I got a ticket in Texas, going West bound down that long straight hill before Fort Stockton for 89/70. Got hold of this guy over the internet and he came back with it would cost me the bail plus $400, no points just didn't have to get a ticket in Pecos County for the next six months.
What pi$$ed me of was the front pilot, who was trying to get outa the way, and the rear pilot, that was trying to keep up, didn't even get a warning :D :D |
