Please HELP!!

I'm A New Driver Recently Out Of School. On My Way To Tennessee I Got A Speeding Ticket In Va. In My 4wheeler (85 In A 65, Damn Rental Cars Drive So Smooth It Sure Didn't Seem Like 85) Heading To The 1st Company I Was With (Usf Glenmoore). Then, My First Week On The Truck I Had An Accident (Preventable Non reportable) Out In California. I Know Poop Happens But It Seems Like No Companies Feel The Same. Swift Just Turned Me Down For Reasons Unknown To Me (They're Not At Liberty To Disclose Why) But I'm Sure It Has To Do With My Incidents. So Can Anyone Tell Me, Am I Royally Screwed? Do I Have Any Options And If So What Would They Be? Should I Try For A Dump truck Job Or Are There Any Companies Willing To Work With Me? I'd Hate To See The 4500.00 I Spent On School Flushed Down The Drain In 1 Bad Week. Any Help Would Be Greatly Appreciated.

It's been a while since i've posted on here, due to the lack of a working computer, and honestly lately i don't have a whole lot to say. But having passed my four year mark in my driving career, i have to comment on this post. I'm sure you knew going in to your training that with the money you spent getting your license, you would have to make a commitment to be a safe driver, and take whatever steps necessary to become productive, and prove to yourself that you can be a professional driver. That professionalism needs to not only be exuded in a big truck, but in your personal vehicle as well. There's no excuse for 85 in a 65, and then to still be given a chance with USF, and screw that up with an accident. We've all had our close calls, but i'm proud to say after 4 years of driving, i've not had 1 incident, or speeding ticket, and i know there are a ton more guys on here who can attest to way more than that, 1 million accident free miles, 10 years safe driver, the list goes on. Get your head on straight before you think about driving a big truck, I don't know why on this day i felt i needed to post this comment, but lately i've taken pride in what i do for a living, and after 4 years i still have a perfect record to show for it, straighten up and do your best to act professional, after all if CDL's were'nt reserved for the professional drivers on the road, we'd all have them.

f22accordcd7 09-10-2007 10:59 AM

OPINIONS aside, do you know of any companies willing to give me a second chance?

BigDiesel 09-10-2007 11:10 AM

Nope....

I'm guessing the 20 over is what killed you at Swift. I gotta wonder, how could you be doing 20 over on cruise in a rental car. BOL

inmate1577 09-11-2007 02:57 AM

I'd say...start studying now.

You guys are just wrong.

In all seriousness, though, the OP is going to have a nearly impossible time of getting into the trucking industry at this time. I'd go find something else for a few years before trying again. Keep your record clean, too.

Hey Millersod,

Just wanted to let you know I finally left CCC and made a huge jump to UPS Frieght.... City Driver for now but have my sights on linehaul within the next year or so... Regardless it looks as if I am working for my last employer....

Best part of all is my take home pay with UPS Frieght is twice as much as triple C including the fantastic benefit package we have.

Hope all is well for you just down the road in Brooksville.
Take Care

Double R,

You posted the wrong menu from McD's. It should be the graveyard shift menu. Having him study those breakfast sandwiches would be pointless as we all know he stands no chance of getting that coveted early dayshift position.

You should be ashamed of yourself and banned from the board for misleading this poor fellow who is just trying to provide for his family...

Besides, I don't think the drive thru would be the best place for the OP. Seeing all of those cars would probably be too tempting and set him up for failure.

The breakfest rush is a killer :D . Besides, McD's starts serving breakfest at 2AM.

5 am here in the Big Apple maybe he should start smaller like a gas jockey.

Jay B 09-11-2007 10:24 AM

Waffle House, I almost shot coffee out of my nose when I saw that. That is the funniest thing I have seen in 2 weeks.

Anyway, I am personally very happy that you will not be driving a truck any time in the forseeable future. I feel much safer this way.

f22accordcd7 09-11-2007 12:15 PM

thanks for all the positive encouragment im so glad i asked for help here. i pray none of you ever make a mistake of any kind ever in your career, for if you do the taste of humble pie might just kill you. maybe i did get in over my head, but i dont give up so easy. i've learned alot from that one week and i've learned alot in the 3 days since i've posted asking for help. mainly to pay even closer attention to what i do behind a wheel and the other is that there are alot of pompas self serving insecure drivers who remind me of a bunch of unforgiving bible-thumpers. some people have provided some good knowledge and i thank them whole heartedly. the rest of you should report back to your childish bickering on your cb's that flood the airways

Colts Fan 09-11-2007 12:38 PM

This guy can't be real. Just another joker. Look at his original post. Why the hell would you capitalize the first letter of every word on the post?

f22accordcd7 09-11-2007 12:41 PM

it was an option on the spell check page, didnt mean anything by it, and yes im serious, i need and asked for help and i get ripped on, told i should work at mcd's or waffle house or pump gas, feels like im in highschool all over. childish to say the least.

First of all,did you just pay for the ticket?Rule number one you NEVER just
pay for a ticket. When you have a cdl you have to fight every ticket with a hired lawyer. It can get expensive but worth it. Get an MVR report and see what is on there. IF that ticket is on there than your only chance of getting hired with a company is to hire a lawyer and take it to trial and/or have it expunged.Having 2 incidents in one week usually shows trouble to most carriers and not having any driving experience doesn't help either since most insurance companies won't accept it. You may not be able to do anything about the incident but there may be a chance with getting rid of the ticket.

f22accordcd7 09-11-2007 12:57 PM

thank you, thats how i thought replies would be, no i didnt just pay the ticket, its not even thru trial yet, just pending. i live in pa and it was in va, should i get a lawyer from here to go down with me or should i get a lawyer from down there? thanks again for the respect.

call a lawyer in the area of the ticket, they will usually show up for you and atleast get it down to a non points ticket.

f22accordcd7 09-11-2007 01:13 PM

non-points ticket.... does that mean the speed will be reduced too? also, any idea, if just a rough estimate, on the cost of a good lawyer? and thank you for your respect its refreshing

The cost for a lawyer can range anywhere from 300.00 to 500.00 plus the cost of the ticket. For a ticket to be nonpoints either the speed will get reduced OR the ticket may be changed to a nonmoving violation. Some counties may even offer probation or disposition. Im not sure how Va. is with speeding tickets but a good lawyer will be able to get it reduced or change the charge altogether.BTW,in the future you may save on attorney fees by becoming a member of Driver's legal plan. I think this is their website.www.driverslegalplan.com. Their membership fees are only 150.00 a year and they will charge a flat fee of 100.00 for every ticket once you are a member regardless of what court they go to.

f22accordcd7 09-11-2007 01:58 PM

wow that sounds like a sweet deal, i'll definatley check that out. one other question just came to mind, is it true that a company that you've applied to, gone through their orientation, was about to be placed on a truck with a trainer but denies your employment can do so without being obligated (maybe obligated is the wrong word... when i asked why they told me "we are not at liberty to disclose this information) to tell you why? how do i know its not for discriminatory reasons they denied me, or if its something they saw on my DAC dont i get the chance to dispute it before they just write me off? i know pa is an at-will state but would that apply when i didnt even get hired?

bouncer 09-11-2007 03:09 PM

What's wrong with pumping gas ?

They do not have to tell you anything.

how do i know its not for discriminatory reasons they denied me,
You don't.

or if its something they saw on my DAC dont i get the chance to dispute it before they just write me off?
No

i know pa is an at-will state but would that apply when i didnt even get hired?
No company is under any kind of an obligation to hire you if they invite you to orientation. An invitation to orientation is just that...an invitation. Most companies do no consider you an employee until you are in that truck, signed off, and rolling with a load. In those cases, simply telling you to go home is completely within their rights.

However, there are some companies that consider you an employeed as soon as your foot hits their terminal. In those cases, if they send you home from orientation, you just got terminated, which is infinitely worse.

You got mad at a lot of the advice on this thread and while some guys were giving you a hard time, the advice is still valid. You are not in good shape as far as getting a trucking job. You might get lucky and find something, but the chances are not good. The advice of going to work elsewhere is valid. Let things drop off and cool down for you and you'll have a better chance.

You can always try CR England. Not joking either. At least it's a job driving if you want to do it so bad. Just don't lease and you'll be fine.

there is a gauge, usually on the left above the steering wheel. it has a needle and some numbers on it. the needle will point to a number, this is the speed you are going. some are digital and will display a number, this will also be the speed you are going, look at the big white sign on the road that says what the speed limit is and then look at your gauge, this will help you determine if you need to slow down

ROFLMAO: This says soooo much about drivers NOT watching what they are doing while driving. That is part of the job as a DRIVER! Looking at your gauges on the dash!

I don't really think he came hear for a lecture. Of the two incidents the speeding ticket is you biggest concern. Twenty over is considered reckless driving by most companies.

CrazyTulip 09-16-2007 12:33 PM

Also there is information on this website regarding your DAC. You can retrieve the information as shown on your DAC report so you can see for yourself where the trouble lies.
If you can get that lawyer and get the ticket thrown out or lessened, you're still stuck with the accident. If the ticket is thrown out, you might still have a chance although it will be hard.

Take care.
