How do you lose this case?
A trucker goes in for a trim but gets his schlong lopped off?

From what I could glean from the articles I read about this, the plaintiff lost because he had penile cancer that the doctor found when he had the plaintiff on the table to do the circmcision and he only removed one inch, the rest was removed by a subsequent doctor. In other words, the plaintiff lost because the jury felt that it was more important that the doctor saved the man's life than that the doctor removed a part of the man's schlong without having specific permission to do that.

Had there been any kind of biopsy or anything at all that led doctor and/or patient to believe cancer was present or likely to be? The picture I get in my head is of the doctor standing there, scalpel in one hand, diseased appendage in the other and shrieking "Holy guacamole look at that! Should I wake this guy up or should I just go ahead and start pruning?" I get that he didn't take the whole thing but this isn't exactly toenail trimming. It won't grow back. I think I'd be upset, too. Or maybe this was a case of a dirt bag lawyer thinking that " . . he didn't give specific consent . . half the jury will be men . . they will feel this!" What do you think? |
