In the various articles I've read on the recent California Supreme Court decision ("Gay Marriage Returns," Review & Outlook, May 16, Letters, May 24) declaring illegal the California law against gay marriage, many have said that the court had little choice since the California Constitution prohibits "discrimination." As a recent letter to the Journal put it, "the state constitution, as now worded, does not allow voters or legislators to limit by law the rights of any group." Logically, if the claim that the state constitution prohibits discrimination is true, how can any law limiting the exercise of any right or power be constitutional?
If marriage laws cannot limit the rights of gays, it would seem logical that the marriage laws cannot limit the rights of polygamists. If polygamists were to sue for the right to marry more than one partner, would the California Supreme Court rule in their favor? Or does it favor only the politically correct?
If the state constitution does prohibit limiting rights of any group, how can laws against robbery, rape or murder be legal? Do not such laws limit the rights of robbers, rapists and murderers?

I would be willing to bet if anyone tried they would lose since the split speed limit law does not say at what rate a travel a person can go at maximum but rather the rate of travel an object is allowed to go.
If a person was able to run 100 miles per hour there would be nothing they could do about it. :wink: |

Actually, as a legal precedent goes.... this question is not so far off!
Couple that with the fact that (as I understand it) California is under pressure to "close the gap" between truck speeds and POV speeds OR lose major amounts of Federal funding for their highways.....
And one MIGHT have a case!
I don't have a link to support the "rumor" I have heard, but I believe it is possibly true. Now.... whether that means that Cali will RAISE the truck speed limit... or LOWER the POV limit, I'm not sure!
However... IF they have received such notification from the Federal government, and are dragging their feet on implementing such a change... it would be quite possible to defeat a speeding ticket based on the failure of the State to "act in good faith" concerning a Federal "directive."
A good lawyer could at least secure a "prayer for judgement continued" in such a case, pending the State's decision and reaction to the Federal stipulation. (IF it is true.)
Anyone ELSE hear about this "requirement" that Cali close the gap or lose federal monies? |

Ahhhh...... But, now, it's the person that is controlling the object in a manner that IT moves at that speed. According to that, it is "unconstitutional" for them to pass a law that limits the persons right to control an object in that manner. And, since it says "group", I believe a substantial percentage of the drivers taking their trucks into and out of CA would also constitute a "group".
I don't believe you could make it cover weight or logbook, but maybe the "BRIDGE LAW".... And, the "IDLE LAW".... :lol: :lol: :lol:

| I've seen arguments of this nature before, and from what I remember, the term "group" only applied to race, sex, or sexual orientation. |

| Unless you can prove that a truck is a race, religion, belief or age, you would lose this one!! Made me laugh though, I just hope the post was a joke and he really wasn't serious, anyone with that little common sense doesn't need to be driving an 80,000 pound vehicle! |

My truck is a transformer! it is alive. Whether a unit is based on carbon or Silicone should make no difference to how it should be treated. All units that think should be treated with respect. |
