How can they determine what each company needs to charge to be profitable? The motor carrier should be responsable for their own profitablity or not be in business.

WASHINGTON (AP) – In response to the spiraling cost of diesel fuel that is crippling the Nation's Transportation infrastructure, the U.S. House met in secret throughout the night, and passed far reaching new Legislation. The Senate is meeting, also in secret, at this time in an attempt to pass the Bill today, and have it become Law effective June 1st, 2008.

The House Bill HB-0804-2956, known as the “Transparency and Fairness in Transportation Act”, looks sure to pass the Senate overwhelmingly on the first tally of voice votes.

While the details and official language are still being worked out, we do know that there are three main components, and each has been addressed in this Bill.

The components are, as we understand them...

1. Shippers and Manufacturers will be required to pay a predetermined transportation rate, to be determined by a newly enacted panel, known as the Transportation Rate Equity panel.
2. Brokerages will be required to limit their commissions to a maximum of 8%, and must divulge the name of the payer, the total amount of each transaction, and be responsible for the profitability of the Motor Carrier hauling the goods for which the transaction is contracted.
3. Motor Carriers may not charge more than the rate set by the Transportation Rate Equity panel, and in any case, may not achieve a profit in excess of 10%.


Also included in the proposed wording of the Bill, is a Diesel Fuel Proportioning clause. This clause, we're told by an unnamed source, would “portion” or ration diesel fuel to Motor Carriers under the authority granted Congress, to ensure that all Motor Carriers obtain an equal share of needed diesel fuel to complete their movements.

More details as they are released.
