Ok Rev - let's see your answer to this one:

The setup:
Six lane interstate (Three lanes going each direction)
Signs indicating "No Trucks in Left Lane"
Speed limit of 65mph
Middle of nowhere (not in a congested area)
One other vehicle on the road around you
The vehicle in front of you is driving in the center lane at 55mph
Ok, you're driving along in the middle of the night and come to this scenario. You can easily pass the vehicle in front of you, as you're doing the speed limit of 65.

The problems are these:
a) Illegal to pass on the right
b) Left lane is posted as 'no trucks'

The only time I have ever seen it illegal to pass on the right is when the right hand "lane" is the shoulder/breakdown lane.

I dont like passing on the right, eventhough in most states it is legal...'slower traffic keep right' doesnt mean 'no passing on the right' eventhough i think it should actually say that.
I usually flash my brights to alert the driver of my approach and hope hes not an egoist that will stay there because 'its my truck and ill drive it how i like'. Ill call on the cb and ask nicely, but if i dont get a reasonable response and am tired of doing 55 on his 6, ill pass on the left...
Passing on the right is dangerous in my eyes.

Uturn is right - to an extent. While some individual states MAY have a law regarding passing on the right, there is not FEDERAL law that makes it illegal.

I would pass on the right at a reasonable speed.

I would pass on the right at a reasonable speed. Just a bit of trivia for you here Rev...
You may only pass in the outside lane of a British motorway when
1)Instructed to do so by a police officer
2)Instructed by an escort to an abnormal load
3)When innermost lanes are closed and signs are pemitting use of outside lanes
4) In the interests of safety..i.e.emergency situation
5) Wen ya Oirish and da laws don,t apply at all at all at all

If the person in the center lane isn't keeping up with the flow of traffic or speed limit, its legal to pass on the right, granted you don't do so at a speed over the speed limit.

You should be to the right anway :)

They are? I always thought of them as morons.

The 4wheeler is not the stupid one here. He is in the correct lane, doing a speed between the moron in front of you and the speed limit.

In the given scenario, I would pass on the left, BLOW his dang doors off, and blast him AND his mother on the CB the whole time! I'd cuss his company for lousy training AND his mother for not breast feeding him! 8)

Then, I'd cut back over in front of him and flick my markers to mock him.

Ooops, I thought you said the slow driver in front of you was in a truck!.... never mind!
