My Bil who is a truck driver just called my husband to ask him to pee in a cup for him because he isn't sure if he can pass the random. Of course, Jeff told him no. It wasn't his problem as he doesn't touch the stuff.

He is planning on getting someone else to do it and have the pee with him when he has to take it on Friday. We tried to warn him that it probably wasn't going to work. He already has a failed drug test on his DAC.

Just wondering, what kind of trouble can he get into with doing this and what about the person who gives the sample, which will NOT be my husband?

They prolly would never catch the "donor", but IF they did, I'm sure he/she would be fired and I'd also bet that there is criminal charges that could be brought up on both parties.

Yeah, BIL is a winner. Last year he fought a DUI charge down to reckless driving. Some people never learn or grow up.

First of all is a Federal Regulation.
Second of all I don't think this idiot could pull it off-Urine HAS to be a Certain Temperature and is recorded on the Bottle before it's shipped(if they don't test it where he's "Giving" it.
THe temperature has to between such and such a Temperature or they'll ask him to "Repeat"
Hooray for your Husband and his Morals.
IF he has a Failed Drug test on his DAC what respectable company would even hire him AND if he's asking your Husband to do this for him he's STILL on drugs. IF this Idiot got in an Accident and they took a Drug test on him the Authorities aren't stupid and they can find out How in the world he passed his piss test previously.
Sorry-Rant over
Bottom line-if your husband did this for him he could be in for a world of hurt.

Bil works for a small tanker company in PA. He said that the boss knows about his past record. I was just curious as to what would happen to the person because he was going to ask my nephew to give a sample. I thought it was a federal issue. My husband tried to tell him about the tempature but he thought it would stay warm enough against his body in a cup.

whisper his name to me-I'll report his ass
I'd Advise telling your nephew not to do it or it could be his ass.

Well my nephew is a minor so I don't know what would happen there. I am not going to report him because he is probably going to hang himself.

Unfortunately, with his record, any company that would hire him AND provide advanced notice of an upcoming UA probably doesn't care.

What can be done to see to it that this guy gets busted, and tossed out of the profession for good??

Yooper is absolutely correct; before he hangs himself, he could kill someone else!!

You would think that this guy would have learned something the first time he failed a drug screen. He was given another chance and is apparently unappreciative of the opportunity. This guy doesn't need to be driving a bicycle, much less an 18 wheeler. He will likely be involved in an accident, at some point. When he is it will be yet another black eye for the entire industry.....not to mention that someones life could be ended or changed forever because of this drug addict. Without this type of individual, none of us would need to concern ourselves about random drug tests. By the way, sometimes there is an individual who will actually stand by your side and witness your giving a sample. It is a dumb move to try and beat this system with potentially deadly consequences. :x

Does your BIL's spouse know what he's doing? I think the best worst thing that could happen to him would be to lose his job. The best best thing that could happen would be to lose his CDL. BOL

BIL doesn't have a spouse. He is my husbands brother. That I know of he doesn't do weed or alcohol while driving just when he gets home on the weekends. If I knew of him doing it while driving I would report him.

He has worked for this company for over 2 years. In trucking for about 7 years, no accidents.

Ma'am, you have too much compassion for your BIL and none for the motoring public.
If you know he'd test positive for THC on any Monday when he goes to work, you need to drop a dime to his employer or anonymously to the local gendarmes.
If a victim of his misbehavior, in the event of an accident he causes or is part of, finds out that you knew of his illegal actions, who do you think could also be held LIABLE? BOL

It only takes ONE....

You might want to think about the person or family that he might kill. If he does end up killing someone and the authorities find out that you knew he was doing drugs and or alcohol while driving you might have the law breathing down your neck. You never know what the family of the victim's will do in a civil case. Just an idea, I am not trying to piss you off or come off as a conspiracy theorist, just a thought.
Not to mention how would feel if someone in your family was killed by a drunk or high on drugs driver and you found out someone knew he was like that and might have been able to prevent it.

Just something to think about..... on a lighter note... maybe the moron will get a female to give him a urine sample and it will come back Pregnant. :)
