NJ weigh stations as safe haven?
Is there any law in New Jersey that says that the weigh stations are NOT a safe haven for truckers to park for the night?
I was completely out of HOS to drive and everything else was filled, no place to park for the night. Every place else, the weigh station is considered a safe haven and a safe place to park when you're out of hours. In the morning, the cop gave me a ticket for trespassing. There were 'No Trespassing" signs. Has any one contested one of these tickets and gotten an okay to park in a New Jersey weigh station when there is no other place to stop? This was on I-78 W/B.

I have never heard of someone getting a ticket for resting or taking a break in a weigh station. I never take a break in a weigh station. I don't want to take a chance of them messing with me. If you want to fight it, you may check with one of the trucker law firms. If you are a member of OOIDA, there is one that offers a discount for members. If it were me, I would fight it. If you are in the area you could go to court and fight it without an attorney.

Find out how much the ticket is. I got one in a local town and it was only $20. I fought it and won because the ticket was written at 11:00 pm and said it was for overnight parking. I was able to fight it through the mail. If I had to go to court it wouldn't have been worth it.
Trespassing may be a whole different story.

Where exactly were you parked, in their parking spaces for the cruisers? Was it posted no parking or no trespassing?

Yeah, there were no trespassing signs, but what do you do when you're already past your HOS? Isn't it public land? Didn't my tax money go to pay for it?
I'm a member of U. S. Legal Services and they said that because it was "just a parking ticket," it doesn't go on my DAC or MVR, they don't and won't handle it, but would 'refer' me to an attorney that I could pay for out of my own pocket. What? $400 lawyer fee in comparison to $40 to pay the ticket. NO!
And, no, I didn't crash through any gate. It was a wide open weigh station. No barriers if they didn't want any trucks to over night there. A set up to give out tickets.
Every other place I've gone to, weigh station are all safe havens for truckers. I use them often.

No Trespassing means no trespassing......sorry charlie. Even if your tax money pays for it. You and I can't just walk right into the White House even though our tax money is paying for it.
