Default 30 minute break

I have a question, regarding to the newly added 30 minute break.

There's a rumor going around at work that DOT is discussing about possibly taking away the 30 minute break.

Have yall heard that?

Haven't heard that, but I wish they would eliminate it. We're already nanny-fied enough without them telling us we need to stop for 30 minutes when we're not tired.

I believe that they have eliminated it for those only traveling 150 mile radius. At least that was in discussion. I think the rest of us will need to live with it.

in New Zealand we have to have a 30min break every 5.1/2 hours, allowed to drive for 13hrs so usualy fit it in while getting loaded or unloaded .lets us get paid for 14hours a day.75hrs a week then 24hrs break.

I missed it by 50 miles..
I run a 400 mile round trip.
Thanks guys. I heard a rumor that they were going to eliminate it, but I have my doubts.
I don't mind the break, I take it at the warehouse, but it's the 30 minutes off the clock I don't like.

How do yall do it? Yall just draw a line, and keep driving?

First, Wabbit, if your job requires a CDL, it is a 100 mile "radius," not 150 mile. But, it is possible to do a 400 mile round trip and always stay within that 100 mile radius. Do you DO that? Or is your primary (or only) destination 200 miles out from your yard (more or less in a direct path?) I.e: If you travel outside that 100 mile "radius" from your yard, you don't qualify.

IF you qualified as a "short-haul driver" per 395.1(e)1.... the 30 minute break would not apply to you as of right now. See the following decision by the court:

http://www.fmcsa.dot.gov/documents/h...e-Guidance.pdf

Here is the "short-haul" regulation:

Scope of rules in this part. - Federal Motor Carrier Safety Administration

To be technical, it's 202 miles from our yard, to our warehouse in Lubbock.

We do fall under the break rule. We looked into it, to see if by chance are exempted. But no luck lol..

Don't forget that it's AIR miles, not street miles.

I agree that the 30 min mandate thing is just nanny state stuff, but I find it truly amazing how drivers are so averse to the idea. In any other profession, if you did not give the employees at least a 30 min lunch break in 8hrs, there would be almost a riot. And there would be armed insurection if an employer had their employees work 11 hrs without a lunch break. When one steps back and looks at the big picture, some of this prattle looks so amusing.
