Since the off-duty (sleeper berthed) driver is relieved of all responsibility for operation of the CMV. As I understand Golfhobo's guidance to new drivers. Drinking alcoholic beverages while in the sleeper should not be a problem at all for the relieved driver on Line 3. How easy it is we forget that the sleeper is an entity entirely unto itself. I'm glad that Golfhobo cleared this up for us.
I'm thinking of trading in my local CDL for an OTR CDL and getting in on the party! Hell, I had no idea what I have been missing. Thanks, Golfhobo!!!

Yes! Otherwise, you could be considered "awaiting dispatch" and might be considered on-duty. You can only be considered OFF-duty while DRIVING your unladen CMV full of alcohol to your home! Being PARKED or "relieved of duty" doesn't count.If so, do I also have to log line 5 at home?
NO. There are only two lines that are considered ON-duty.... lines 3 and 4. Unless, of course, you are polishing your chrome while OFF-duty (especially on a 34 hr reset.) Then you are servicing your truck and therefore must be ON-duty according to the on-duty reg. The only exception to this is if you are DRIVING a truck full of alcohol and you OWN the truck, or are heading to WalMart. And even then... you MUST be on line 5 unless you are on line 1 or 2. [line 2 is NOT recommended while driving.] Whatever you do.... do not touch or get IN or ON your CMV while you are off duty! This will automatically constitute an ON-duty situation and blow your 10 or 34 hour reset! [unless your are logging line 5.Does line 5 count toward my 14/70 hours?
This very serious and important "exemption" is still being researched by FMCSA experts like Mike M. I think the answer lies somewhere in whether or not you are "carrying" it or possessing it. And it could depend on whether you were DRIVING your unladen CMV (full of alcohol) while OFF DUTY or ON DUTY.Is mouthwash a line 5 item?
To be safe, I recommend chugging all the beer and booze in your sleeper, (because as long as you're in the sleeper, you are not considered On Duty, although you MUST be On duty to log sleeper berth time,) then topping it off with the mouthwash. Throw away all the evidence, (without passing through the ON Duty cab of your vehicle,) wait 4 hours, then send in your "ready" macro!
This will put you on line 4 and the question would then be moot.

There are TWO regs that apply to this situation, young'en! I don't feel like quoting them, but the first is that the DRIVER cannot OPERATE a CMV with unmanifested alcohol on board. It is HIS responsibility to make sure there is no such alcohol on board BEFORE he starts to DRIVE the CMV.Since the off-duty (sleeper berthed) driver is relieved of all responsibility for operation of the CMV. Also, though it is disputed AND under review.... if the codriver were to come out of the sleeper and sit next to a DRIVER of a CMV (which means it HAS to be "in operation,") his duty status would be line 4... On Duty Not Driving. At this point, HE could not have any trace of alcohol in his system (above .02 BAC) or HE would be in violation of the regs.
[I HOPE you get my point...which is that the reg concerning the duty status of a co-driver (unless a trainer who does not drive) is line 4 IF and ONLY if he is seated next to someone DRIVING the CMV. It says nothing about the two of them sitting in the two seats of the cab while the truck is parked and they are BOTH "off-duty." The question did NOT say "what is the duty status of a co-driver (or ANY driver) seated in the passenger seat of a CMV which is parked.] I WONDER why that is? Could it be that the distinction is a CMV in OPERATION?
