Hi everyone,

Just wanted to warn drivers to check their DAC reports when they leave a company. I was working for a major company. It was Saturday and I was sitting in Dallas having just delivered a load. No plan out and I figured I wasn't going to get one until Monday, so I decided to have a few beers and kick back and watch some movies. About 2 hours later a load comes across that has to pick up immediately.

I was a little buzzed, but not drunk. I decided to go get the load and got pulled over for an inspection by a trooper on the way over. He arrested me for DWI, was just barely over the limit.

Long story short, I hired a lawyer and was able to beat the charge because of a discrepancy in the calibration records of the breathalyzer.

Even though I have NOT been convicted of DWI, this company still puts it on my record and won't take it off. I think I'll probably have to get a lawyer to make them. Just a warning to the noobs to watch their DAC reports because companies will put false information on them.

You should not drive a truck for at least 10 years of sobriety. So what if you got off on a technicality you still drove under the influence. Hopefully you are blackballed from this industry because i don't want you on the road around me or my family.

The point is, I had my day in court and won and my old company has to accept that. It just sounds like a case of hard feelings on their part. If I had lost I would have fully accepted the consequences, but I did not lose. I suspect I won't be blackballed for too long once the legal action begins.

I agree with WSYROB, what a completely stupid thing to do, and then to claim "I'm just buzzed" no biggee. I'm glad the company did what they did, and hopefully it will follow you in the next few years, you deserve whatever you don't get in life out of trucking.

Yeah that's the amount of time most companies applications require. They will ask it in a way that you will have to disclose what happened. They won't care that you got off on a technicality.

None but I know hundreds who will wait at least 8 hours after drinking before getting behind the wheel. You aren't one of them. Find another profession.

In all states its written that buzzed driving is STILL drunk driving by classification. I don't know how many I arrested that felt they wern't drunk, but my field sobriety tests showed otherwise due to impaired cognitave abilities.

I agree with the others... just because you got off on a technicality does not mean you were innocent.

As for the personal attacks, they mean little coming from someone in the sleeper of a truck who's typing insults in between porn site visits.

Finally, to address the technicality of my acquittal; trashing some cop's shoddy work in front of a jury of my peers is more than getting off on a technicality. So Mystikal, yes I am in fact innocent. The law is that if the state can't convict, the defendant is innocent, and the state failed miserably in this case.

Personally I've never touched a beer in my life and don't plan on starting anytime soon.

I wish you were in Illinois when you got pulled over. If you have a CDL in this state and are driving a personal vehicle, your blood alcohol level has to be 0. Yes a total zero. They would have had fun with you in a commercial vehicle. I don't think you're supposed to drive a commercial vehicle for 10 hours after any alcohol consumption, but I could be wrong.

Also, were you sitting in your truck drinking? You said the message came across the qualcomm that you had a load so I'm assuming you were sitting in your bunk kicking back a few. Major illegal by the way. The only time you can have alcohol in a commercial vehicle is if it's on your BOL.

Also, it's illegal to drink when you're subject to dispatch. You obviously were, you just assumed they wouldn't give you anything.

You're trying to justify your actions, but they aren't justifiable. You could have told them you'd had a few beers and couldn't drive BUT I'm assuming you didn't want to do that and get fired, right? You should have done the right thing and not drove- PERIOD! I wish they would have given you another test at the station with a different machine so you'd be gone right now instead of out in the motoring public.

No, you are not "INNOCENT! I'll bet you anything you want that the paperwork you have from the courts does not have the word "INNOCENT" anywhere on them. I'll bet it says, "Not Guilty" which only means that you were not found guilty AS CHARGED, that the prosecutor failed to present evidence to convict. This is far from being INNOCENT!

Were you too drunk to drive, yes, does your DAC need changed, depends, does it state you were terminated for being "charged" or "convicted" of the offense? Again, I'll bet your DAC states that you were terminated for be "CHARGED" with DWI which is a proper entry. I see no reason for your DAC to be changed, you were charged, you beat the charge which is what you have to inform any prospective employer.

If you were stupid enough not to inform your dispatcher you were drinking and refuse the load you deserve exactly what you have gotten yourself into.

Something else to think about, you better check with the local DMV of your state and ensure you actually have a valid drivers license, much less a CDL. In many states, a charge of DWI results in an automatic suspension. They don't have to inform you and for the most part, the first time you will know about it is when you get stopped and charged for driving with a suspended license.

I know this guy (cousin) and am pretty sure he probably went ahead and drove because "he was just buzzed"....

I've known for years he shouldn't hold a CDL, in fact he just got them back 3 months ago after a 1 year revocation.

This is probably "it" for him this time (I hope and pray) and it's just dumb luck it didn't take a life to do it.

I've seen many folks decide to quit drinking but I've never seen a dumbass quit being a dumbass.
