Thread: Defective Equipment

    Default Defective Equipment

    I thought defective equipment ticket was a non-moving violation, at least thats what the trooper told me & former employers. I was just getting a quote for auto insurance for my car & was quoted at $291 for 6 months. At the last step, however, it said I had two equipment failure tickets in the last three years, so the quote jumped up to $491. I called up progressive and they said they consider that as a moving violation.


    Both of these tickets were in Virginia (2005, '07), the former being in a personal vehicle and latter being in a CMV. How would I go about about getting a definitive answer if these are indeed moving violations.

    You could try pulling a copy of your MVR. Most states only list moving violations on them.

    Other than that, your best source of information would be either a traffic judge or an attorney who specializes in traffic law.
    Finding the right trucking company is like finding the right person to marry. I really comes down to finding one whose BS you can put up with and who can put up wih yours.

    Email VA State Police about it. They can clarify it and show a copy of their response to your insurance. If that don't fix it, get a lawyer and fight them over it. Could be a mistake by the VA DMV on your MVR, they seem to be doing that a lot to people anymore. Don't expect DMV to fess up to making a mistake, they have a tendancy to say it's all your fault when they keyed it in wrong.
