Jeremy Mayfield asks judge to rescind suspension - NASCAR - Yahoo! Sports (http://sports.yahoo.com/nascar/news;_ylt=Ah.MKTwt5SZMd_VZot.NW2nov7YF?slug=ap-nascar-mayfieldsuspension&prov=ap&type=lgns)
Well, this isn't the first time Mayfield has gone to court to save his rear. He did the same to Ray Evernham after Evernham fired him and Mayfield brought out some nasty truths that Evernham was trying to hide. I find it interesting here that Mayfield's "B" sample was tested by the same lab without him ever asking it to be tested.............or so he says.
Mayfield has made it public what 2 things he took, if he took more he isn't saying but that is more than what NASCAR has said thus far on it.............

NASCAR could come out of this with a major black eye and on the heels of the whole Carl Long incident in which fans are already incensed with the punishment he got(hope he wins his appeal.) I've said it a number of times, the problem starts at the top with Little France running things. He's done his best to change as many things as possible and it hasn't helped the sport at all. It's only further pissed the fans off more and more with each change. His dad, Bill France Jr was ok but he was a lot like Brian currently is, my way or get the hill out of here. Big Bill was not like that, he was for the fans and listening to the fans.

I asked a couple friends of mine in Law Enforcement. Helps I went to HS with half the local PD well it turns out that the Script and Clariton D well even their OWN UNION IS AWARE that combo can CAUSE A FALSE POSTIVE for METHANPETHAMINES. Think about it if he took a Clarition D and then his Script then was popped for his wiz quiz there was according to 4 officers I taked to and all 4 are on the local Drug Enforcement Squad so I think they know there stuff 2 of them are the Union Stewards there was a 80% chance it would show a FALSE POSITVE IN BOTH TESTS.
Now we have NASCAR which to this day has yet to relase to the DRIVERS and TEAMS any LIST of BANNED DRUGS SUBSTANCES OR ANYTHING. Hell I bet they would BAN A DRIVER FOR TAKING ASPRIAN IF THEY COULD. BTW Claritan D is the most stolen drug in the nation why it along with some other chemicals is all you need to make METH.
I am betting that Mayfield is getting the SHAFT on this one and NASCAR will get a black eye on this one. They are refusing to name what he tested postive for to his ATTY and that right there says NASCARS case is based on SMOKE AND MIRRORS and is being tried in the PRESS ONLY they have nothing.

From reading the complaint I wonder how LOUD NASCAR and the France family is going to scream when the JUDGE and JURY goies you owe Mayfield 100 MILLION in PUnitive DAMAGES. If a Trucking company had their lab handle their drug testing the way Nascar did they would be OUT of BUSINESS.

One the containers were NOT a Sterile you the Testee sign for it like we have to when we take a Wiz quiz. If you read the Lawsuit PDF it states that he was told take a container for his FROM A TABLE FULL OF CONTAINERS that were already UNSEALED AND UNSTERILE and in Mayfields lawyers words could have been CONTAMINATED. If you are a Sports Sanctioning Body using a MAjor Lab to do Drug Testing you can andd should Spring for the Seald box for Drug Testing. Also the suit goes on to claim the Lab that tested it Was not Certifed by the State of PA to even test for even pre Employment Drug tests of ANYKIND yet Aegis was using it to hold drivers careers in their hands. Next NO VERIFIED CHAIN OF CUSTODY. Drug tests are treated like EVIDENCE yet there was no techs initals on who took the samples or broke any seals. Last the B sample is REQUIRED to be tested by a Differant LAB NASCAR HAD THE SAME LAB TECH AND MACHINE RUN IT 24 hours later and used all the B sample. Therefore Mayfield can not dispute it at all.

Here's what I got Rev, NASCAR has screwed up and backed themselves into a corner with no way out.
The lab was not licesened in the state of PA where the testing is done, which means they cannot legally do what they are doing.
The containers may have already been contaminated before testing because they had no seal on them.
No "B" sample can be tested by the same person or lab and that comes straight from NASCAR apparently. In this instance it was tested by the same person and same lab. Per NASCAR Mayfield can ask for his "B" to be tested and can specify who he wants to test it. He says he never asked for his "B" to be tested.
Per Mayfield's lawyer, nobody has any idea who handled his samples at Aegis, the logs that are supposed to exist do not exist.
No more "B" sample is left so it cannot be tested again by a different lab. My question to that is, what about the "A" sample did they do the same to that one, use it all up? How much is normally used in testing anyways?

If you don't like NASCAR, why are you even reading this thread and then knocking on NASCAR? Make you feel special or something because you can make a lame attempt at being a punk? You made yourself look like a real tart after yesterday's Dover finish with that comment. The final 25 laps were great.

Now NASCAR has filed a countersuit against Mayfield. This is starting to turn into the whole Mayfield v. Evernham deal again. Both filed suits against one another and then settled out of court after Mayfield threw a couple haymakers against Evernham in court. NASCAR obviously won't be as easy to knock down.

25 long ass left turns ...even my boxer dog who loves chasing the laser pointer would run to the couch and take a nap after just a couple laps of that .

"But NASCAR attorney Paul Hendrick said in court that three drugs were found in Mayfield’s system, and the Adderall and Claritin-D were accounted for in the results. He described the third as a “dangerous, illegal, banned” substance, but did not name it."
Well, that shoots the entire Adderall/Claritin apology down.
I'm still rolling with the Cheech and Chong theory.............

I dunno know Belpre. I've heard some rumors out there that while those 2 drugs were accounted for and ok'ed, they created a false positive for something else. The rumor goes that those 2 drugs together can fool the drug screener into thinking that something else is in the body when it isn't and it's ahppened plenty of times before to regular joe's.......I've heard it can give a false positive for meth but again, that's all rumor so read into it what you want.
I think it's totally stupid now that they will admit that he had Claritin and Adderall but continue to hide the mysterious 3rd substance. They have at least confirmed part of Mayfield's story...........
*Update*
ESPN The Magazine is saying they have been told it was meth he tested positive for which is considered an even stronger form of Adderall. It can work better than Adderall for someone with ADD or ADHD......

Mayfield will be allowed to race Saturday night at Daytona if he can get something together in time and then qualify. Judge lifted his ban temporarily but NASCAR is looking at filing an appeal to keep him out of the car. If they do not go thru with the appeal, NASCAR has already stated he will have to do a drug test before he qualifies. I find it funny that NASCAR claims, per the labs, that Mayfield had tested positive for a massive amount of meth. Mayfield's lawyer denied that was even possible by just looking at Mayfield's face. He has showed no signs of being a meth head like the results would claim.

All the crybabies on the Nascar message boards are saying all the other drivers should strike so they don't have to be on the track with Mayfield.....dummies.
I don't listen to the loud mouth ahole, but apparently Bubba the Love Sponge took a drug test on the air and came back clean, then took Adderall and Claritan D and got a false positive for Meth.......

Which is what message boards have been saying all along............I'm curious as to why they weren't doing hair samples to begin with, much more accurate than the pee test and no worries about the samples, the hair follicles show drug usage much longer.
Those people are fools for saying drivers should strike. 1) They don't exactly have a driver's union in order to do that. 2) Ask Richard Petty, David Pearson and the other old timers how well a driver's strike worked back in 1969 at 'Dega...........race ran anyways and their strike was an afterthought.
