How to report a company

I recently worked for a small hotshot company in the Houston, TX area. I was expected to log illegally, did not have a cab card, no ifta, and upon leaving my pay was not correct for the last two weeks worked. Can this company be reported to DOT or some other entity so that they could be audited or shut down?

IFTA is required for two or more axles with a GVWR of more than 26,000 pounds.

If you suspect the carrier was not accurately reporting IFA mileage you can report the carrier to IFTA:

International Fuel Tax Agreement (IFTA) (http://www.window.state.tx.us/taxinfo/fuels/ifta.html)

Same with the IRP, it's a state violation so you'll have to contact Texas to report your suspicions.

For pay issues you'll have to contact you local Department of Labor.

Now for the logs, be prepared to provide details of exactly you are stipulating was an illegal act and call 1-888-DOT-SAFT or visit Safety Violation Disclaimer (http://nccdb.fmcsa.dot.gov/sv_disclaimer.asp)

How about if you suspect that a company may not be paying all the fuel surcharge to the owner of the truck? I know that by law, it must go to who ever pays for the fuel, but if it doesn't, who do you report it to?

I don't think that is a law is it? I know there was some talk of making brokers list the charges on freight bills,but I am not sure that even passed did it?

There is no law that says the company has to pass on anything to the owner of the truck. Your lease, however, should state something to that effect.

If you believe that the company isn't passing on the full FSC, then you need to request to see the billing for the load. If the company refuses, then get a lawyer involved.

Although I had never seen it in writing, I was told from several sources, about 4 years ago or so, that 100% of the FSC MUST go to who ever pays for the fuel. One of those sources is the owner of a trucking company in Franklin, WI. I was told that it was a federal law, and that there were companies that got into trouble by not paying it all out.

I agree with Rev's comments regarding the lease agreement. I've reviewed lease agreements using fixed FSC rates. The carriers were advised to add addemdums to the leases as FSC flucuated.

Unless the lease agreement covers payment of the FSC the O/O has no legal protection to recoup underpayments of FSC.

I myself have pondered taking that road against a company early on..

then quickly realized that going to the DOT to make a case against a truck company is like riding shotgun

for Bonnie and Clyde and then going to the police to turn them in....it generally isn't going to pan out

very well.

Generally speaking...if one is cooking thier logbooks it is so they can 'chase' the frieght schedules...they are not making much more than the fellow who runs legal.

u have to go the "local dept of labor" for that companys juristiction....im sure u can go to urs but theyll redirect u to the company towns DOL
