VA is working on a bill that essentially reads that the state will not honor the Healthcare bill Congress is attempting to pass in requiring all Americans to get health insurance or go to jail/fine. It passed out of the Senate Committee last week with a few Democrat supporters."This is basically another 'get Washington off our backs' bill," Cole, R-Spotsylvania, told the House Commerce and Labor committee. "It goes back to the original intent of the 10th Amendment and the Constitution, that Congress would regulate interstate commerce, but it would be up to the states to regulate commerce with-in their borders. I know this is a statement bill, but I think it's a statement that is timely and needs to be made."
Cole said he expects that his bill would draw legal challenges from the federal government.
Individual health insurance coverage; requirement to obtain. Provides that a resident of the Commonwealth shall not be required to obtain or maintain a policy of individual insurance coverage. This applies regardless of whether the person has or is eligible for health insurance coverage under any policy or program provided by or through his employer or a plan sponsored by the Commonwealth or the federal government. The measure also states that no provision of Title 38.2 renders a resident liable for any penalty, assessment, fee, or fine as a result of his failure to procure or obtain health insurance coverage.
